Private parking ticket - signage confusing and not clear
« on: December 12, 2024, 04:32:31 am »
Hi all,

Thanks for your help beforehand.
I need some advice as I received a ticket from Eurocarparks beginning of Nov. I challenged it based that signage was not well illuminated and only on the left hand side with poor vision. Please see the pictures- as right side of parking is opened and leads to Morrisons main entrance, I thought it was part of Morrisons too, so I parked there. My appeal was rejected, now only way to appeal is through POPLA - any advice pls?

Originally I went there at nighttime, so I returned to take pictures at similar time.

Thanks for your advice

Hi, I'd love to show you in full my appeal, unfortunately I do not have a copy as appeal for Eurocarparks is done fully online.
I attached pictures and mentioning the poor lighting at the time (it was late evening) and the confusion due parking seems split in 2, one part opened and leading to Morrisons entrance. I attach links of pics I sent them and extra I did going to the same area.

the ones I attached at appeal: https://imgur.com/a/gsPBuaJ

the ones extra: https://imgur.com/a/7tNuag8 I saw only the one on the left next to entrance, so I thought parking Eurocarparks was the left part only and right one for Morrisons - i was new to area and there is Morrisons park further down.

Any advice should I apply to POPLA and if no success try to contact landowner or viceversa?
Thanks for any advice!

Plan A is always to ask whoever has contracted ECP to operate at the car park, to get them to tell ECP to cancel the PCN.

Plan B is to appeal to ECP.

Plan C is to appeal to POPLA if Plans A and B are unsuccessful.

Plan D is to wait until ECP issue a claim for debt issued through DCB Legal via the CNBC.

Plan D will eventually end in a discontinuation if you follow the advice given here and use the defence we would provide..
