A little help here please.
2 hours parking was paid and displayed in advance and a NTK charge was sent for what I assume is an inaccurate accused overstay of 13 mins.
I know that by law there needs to be a leeway of 10 mins, which I think is more accurate than the 13 mins accused.
The parking is a strange one. You enter a series of roads (St Marks Square, Lincoln), which seem to be private, and there are parking signs everywhere but the road themselves are not parking spots. There are several parking spaces off road to the sides of the road and there are actually a few of these roads you can drive through in order to find an available parking spot.
As you can see from the first link below, it seems that the timings reflect when the car entered one of the private roads, and when it left a different private road, rather than when the car was parked in an allotted space and when it left the allotted space. The photos are also time stamped with these same times on the appeal website. The entry was on St Marks the Sidings 17:39:41, and the exit was on St Marks Square 19:53:17. None of these places are the parking space where 2 hour parking was paid. This would make the actual time of 2 hours and 13 mins slightly longer to the time when the car was actually parked in the parking space. The parking space is also not showed in any of the photos.
Should an appeal be made based on this? I’m thinking this letter alone should be enough for a successful appeal but I don’t want to assume. Any help in the correct direction will be greatly appreciated.
