Hello all

Didn’t see the advice on my other topic in time for my own letter, so I ended up sending a response.

I received a letter from UKPC  saying that I had gone 30 minutes over my parking on 17th April It was a three hour window. I can’t find this letter at the moment. On 1st May I reached out to TJMAXX to help me they said they will of my appeal fails.

 I sent them an appeal and I received a response saying that I needed to provide evidence. I didn’t provide it in the time window and they told me I could no longer provide the evidence.. On another topic I have I know all I have said was to remove details for data protection. I saw that after I sent the appeal.

They sent me a few weeks ago a letter saying that it’s with direct collection Baliffs  Limited or known as DCBL. I forgot to respond to to the letter they sent me, I got a chase up letter 12th August

I reached out to Homesense/TJMAXX to help me also with this.

Am I too late to resolve this now?

I have ADHD so sometimes I really struggle to organise things in strict time frames which is why I forget to send replies sometimes or respond to letters in a certain deadline pretty much if I don’t physically write it down and put a reminder in my phone I forget altogether sometimes for weeks on End.

Keep on trying to get the retailer to get this cancelled. If they don't, then it is not really a big deal UNLESS you don't manage the deadlines for certain things.

For now, DO NOT engage with DCBL or any other debt collector. DO NOT try to contact them. They are to be ignored 100%. They cannot do anything, no matter how scary they seem. Ignore.

This is what is going to happen and you willed to note any deadlines... eventually, UKPC are going to instruct DCB Legal (not DCBL) to issue you a Letter of Claim (LoC). The LoC will be different from any debt collector letters because it will give 30 days, NOT 14 days to pay.

Let us know when you receive the LoC as we will give you response for it. 30 days or more after the LoC, DCB Legal will file claim through MCOL and you will receive the N1SDT claim through the post from the CNBC. When that arrives, you MUST NOT miss any deadlines. Let us know and show us the Particulars of Claim (PoC) and the "issue date" of the claim.

We will provide you with a PDF which tells you exactly how to Acknowledge Service (AoS) and then a Defence and how to send it to them. After that, you should receive a copy of the Claimants Directions Questionnaire (N180 DQ) which you simply file away. At some point you will receive your own N180 DQ which must be sent back within 29 days of service.

IN the meantime, someone from DCB Legal will try and contact you and offer to settle for a slightly reduced sum. Do not engage with them. Eventually, before they have to pay the trial fee, they will discontinue. We have seen over 400 of these discontinuations and that is only from the victims that have been in touch and followed the advice and kept to the timeline.

As above, UKPC are usually very beatable, but there will be a number of deadlines involved.

I have close friends and loved ones with ADHD, so I realise the impact it can have, particularly with things such as managing admin. If it is something you struggle with, it might be sensible to see if there is a family member or trusted friend who can support you with that side of the matter, whilst we support with the technical bits.

I wanted to update I still haven’t heard anything further about this. Hopefully they have gone away.

It will not have gone away. You just have to be patient and wait for the inevitable. However, do not let it interfere with your enjoyment of life. Whilst it will inevitably rear its ugly head in due course, it will not amount to anything as even after they issue a claim in the county court, I can say with over 99% confidence that they will eventually discontinue.
