Hi all. I’ve now received my court date which is a telephone hearing on 9th July. Says the claimant needs to pay by 11th June for it to go ahead so I guess I’ll find out soon after if it is or not. However it’s asking me for the following: the parties must by 4pm 21st may file at court and serve on each other the written evidence upon which they proposed to rely , which must include statements from the parties themselves if they wish to give evidence. And then how to layout the info. Please can someone advise what I need to send for that? Is that my defence I’ve already served? Or something else.
Also I’ve moved house. I luckily got this letter on my last day at my old house. Do I contact the court direct with new address or the MCOL?

Did you request a telephone hearing? If so, why? Which county court?

You must notify all parties and the court of your change of address. you can do this by email.

Regarding the documents you need to submit, it is NOT a copy of your defence. It is you Witness Statement (WS). However, you do jot want to submit anything before the claimant submits theirs and I doubt they will. So do not prepare anything until you see sight of the claimants WS. They are still highly likely to discontinue.

Many thanks for your reply. No I didn’t request a telephone hearing I’m not sure why it is one?
Also how will I know if and when the claimant issues his WS? I only have 21days to do this will I be informed if they do or don’t?
What do I write in my witness statement if they do send one?
I’m getting so scared now as I have no idea.

Stop worrying! The claimant is required to copy you into anything they send to the court. They must copy you in to their WS. Even if they leave it to the last minute, it is not a big deal in a small claims case if you submit yours a day or so late.

If they do sed you a copy of their WS before the deadline, then host it on DropBox or Google Drive and provide a link to it so that we can review it and put together your WS for your case.

As I have already explained, I doubt that they will let this go to a hearing and will discontinue before they are required to pay the trial fee.

Thank you all very much for your guidance and help. Today I received an email to say they were discontinuing the claim against me and sent me the N279 form.
I am so relieved this is over and appreciate more than you all know for all your help and support.
