Author Topic: PCN from Bellevue Car Park in Greenwich - Appeal dismissed for unpaid parking  (Read 55 times)

Hello,
I was parking in a car park and when I went to pay the contactless and card option was not working. I did not have minutes to call to pay and did not have coins. I have a blue bade which I used on the windshield. I received a PCN and I challenged this explaining and offered to pay the sum that would have been owed for parking. They declined and I referred the matter to POPLA who are the ombudsman for parking on private land appeals apparently, they also ruled in my favour and now I am being asked to pay £170.

I was in the car park for 27 minutes or so and the charge would have been something like £3.
I feel this is unfair as I did attempt to pay - video proof which I do have and both the company and the ombudsman did not allow me to submit during the process of me challenging this PCN and also did not take into account I have a blue badge.


I have now received a letter before action and have been given 30 days to pay or respond.
The options are limited regarding the debt which says I either
A - Agree I owe the debt
B - I owe some of the debt, but not all of it
C - I dont know wether I owe the debt
D - I dispute the debt

I am not sure if I should tick B or D. If B, do I just keep the amount I would have paid if the machine was working if D what reason do I put.

You are under no obligation or requirement to use their silly forms.

If you dispute the claimed debt, you simply write to them in response to say so.

In the short term, it won’t make any difference. But at least you will have been seen to engage with them.
