On the CMA point - in this case, and more generally, I would encourage posters who have the time, to complain first to the operator and then to the relevant ATA (in this case, the British Parking Association). I would wait until your POPLA appeal is decided (hopefully in your favour), to avoid them batting the matter off with "see what POPLA say".

Once this has happened, I would complain to Eternity Fire & Security, specifically about the way your appeal was handled, pointing out their failure at both stages to properly consider the contents of your appeals, contrary to the guidance recently provided by the CMA. When they brush you off, escalate to the BPA on the same grounds, and ask that they do their duty as an ATA, and as advised by the CMA, to ensure they're holding their members to good professional standards. When they too brush you off, contact the CMA - you can show them the evidence that not only were your appeals not properly considered, but that neither the operator, nor the BPA, took the opportunity to reflect on or amend their conduct (or in the BPA's case, take action against a member for non-compliance), showing an ongoing disregard for motorists, and the CMA.

It's clear that operators and the two ATAs are just continuing on as if the CMA's comments and ongoing investigations are irrelevant - the more this can be evidenced and demonstrated to the CMA, the better.
