PCN - DCB Legal - County Court Claim
« on: »
Parking charge notice received a while ago.

I have completely ignored.

Received DCB letters:
Notice of debt recovery for unpaid parking charge. - Ignored
Letter of claim - Ignored
Now received a County court claim letter

Amount of £170 - Now amounting to £250ish

I am the registered keeper. I have ignored.

Following guidance from previous posts - I need to go online www.moneyclaim.gov
but what defence do I have? Do I need to have a defence?

I cant figure out how to attach a photo of the letters which is frustrating.

Thank you

If you don’t file a defence within 14+5 days from the date on the N1SDT form, they can apply for a judgement in default against you. If you file an Acknowledgment of Service it gives you an additional 14 days to file a defence.

Only you can defend this. The one good thing might be that your lack of contact probably means you haven’t identified the driver.

You need a defence, or you agree to pay them. If you give us more information we may be able to advise further.

I have no defence.
I am the registered keeper and haven't identified the driver.
Parked in a private car park, at night. The driver mustn't have seen the signs.

I assume the driver would be liable to be pay if there is no defence.
Defence I assume could include: Faulty equipment etc?

As registered keeper, the liability can be transferred to you from the driver if the stipulations of PoFA 2012 are complied with.

So far, you have not given us any more information which we could use to help you.

The claim is that the driver entered into a contract by reading the signs, agreeing to their terms, and parking. The PCN is an invoice for payment accordingly. If, for example, the signs were not visible at night you might have the basis of a defence.
