Parking Eye PCN - Holiday Inn Peterborough West

Hi All,

The keeper has received a PCN from Parking Eye, dated 17/07/2024. The event in question is from 12/07/2024 19:12 until 13/07/2024.

I have attached the sanitised version of the notice which is addressed to the keeper - PCN Notice

The driver is a staff member at a school that hosted it's prom in this location on the date mentioned. The carpark had the barriers up upon entry and no signage was noticed, however, upon talking with other staff members today, it's not clear whether this was lack of driver observation upon parking.

The venue has a tablet to enter the VRN into to provide free parking, this was not carried out.

The keeper has contacted the venue and while they say they will see what they do, it's clear the onus is on the driver to enter the VRN. No written contact has been carried out yet as the keeper would like to engage the smart folks here.

The intention of the keeper is to get clear signage photos later today/weekend as Google Maps (LINK) is from 2023 and does not show any clear signage.

Please help inform the keeper of the options.

Plan A is always to get the landowner or whoever contracted the PPC to tell their agent to cancel the PCN. This should be done is writing, preferably by email, as a phone call is not worth the paper it is written on should someone promise to do something and later,mot turns out they didn’t.

There  are technical flaws in PE NtKs in that they have not fully complied with all the requirements of PoFA, specifically paragraph 9(2)(e)(i) which means that they cannot hold the keeper liable. They will dispute that and we have yet to see that point considered by POPLA. That does not mean that it should not be raised and so, the keeper should not identify the driver.

Any appeal must be done as the keeper. PE do not know the identity of the driver unless the keeper blabs it, inadvertently or otherwise. Because of the technical flaw in the NtK, PE cannot transfer liability from the unknown driver to the known keeper and there is no legal obligation, whatsoever, for the known keeper to identify the unknown driver to an unregulated private parking company.

The signage will play a big part in any appeal. Please show us the pictures that you get. Ideally, we would like to see the details on the entrance sign and any terms sign in the car park as well as general views of the car park.

I have started Plan A.

Please find attached the PCN issued to the keeper of the vehicle XXXXXXX.

The driver parked in the carpark as part of the event being held at the time, a School Prom. This was on the 12th July 2024.

As discussed, Parkingeye manage this on behalf of the land owner and state this within the PCN. It would be greatly appreciated that because the driver was attending the Holiday Inn as part of a paid event, the landowner could get the PCN cancelled with written confirmation.

I attached the notice to the registered keeper.

Well, that was remarkably quick! 'Plan A' is always the easiest option, especially with ParkingEye.

Beats me how it was so quick as I wasn't expecting a response so fast. Can't grumble really.

Anyone wise on whether I should expect a cancellation from Parkingeye to confirm or the email from the venue is the best I'll get?

I'd be surprised if they spent their money on a stamp. One way to check if a charge has been cancelled is to wait a few days for it to be processed, then go to the ParkingEye website as if you're going to pay/appeal, then enter the PCN details and see what comes up.
