Parking Ticket Help Needed Please

Hi new to this type of thing can anyone help please. The driver parked in front of a Subway recently which for all the world looked like a legitimate parking space. Letter then received demanding 60 rising to 100. Clear daylight robbery. Can anyone advise me on the best course of action/likely outcomes/timescales? Thanks

They're demanding 100 but it is discounted (a bribe basically) to 60 if you don't want to put them through the bother of rejecting your appeal.

Albeit the Subway isn't displayed on the Google Maps image, but it's basically where that row of shops is. The driver parked up and went into the Subway, bought a sandwich, then left a few minutes later.
I'm the registered keeper of the vehicle.
Incident happened on 18/5/2024.
NOTICE TO KEEPER letter now received from PARKING GROUP THE PARKING PEOPLE
Reason for issue - Vehicle not parked within a marked bay
I'm unable to upload a picture of the letter to this forum, tried registering for an Imgur account but that doesn't work either. Could email a photo of the letter to anyone who can help me?
Don't have photos of the site, but the letter says signage is clearly displayed throughout the car park stating it is private land etc
Basically the driver parked in the layby you can see in the Google Maps image, which I think anyone would agree is a bear trap (others were parked there at the same time)
I'm trying to ascertain how feasible it would be to avoid this charge, how much work/aggro it would take, how long it might take, if anyone could give me an idea please?

It's not PoFA compliant. Only the unknown driver is liable. As long as you, the known keeper does not reveal the identity of the (unknown to PGL) driver, inadvertently or otherwise, they will not be able to do anything except try and con you into paying or giving up the identity of the unknown driver.

As the NtK does not comply with the requirements of PoFA, they cannot transfer liability for the charge from the unknown driver to you, the known keeper.

As simple appeal along the lines of this should be enough but as you are dealing with money hungry ex-clampers, expect the appeal to fail but it should win at POPLA. Do not amend except to add your VRM and PCN number.

I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 (PoFA). just to add this appeal worked
received an email today from Parking Group Limited saying they're cancelling the PCN
thanks again to all concerned

N.B. this was for parking in the layby in front of the Subway sandwich shop in Hyde Park Doncaster if that helps anyone

For any future readers of this thread, the success in this case was based on deficiencies in the notice, rather than anything specific to the location. If you receive a notice you should post your own topic so that we can advise accordingly.
