Parking in disabled bay without displaying badge

Hi all,

We received a Penalty Charge Notice (PCN) for parking in a disabled bay without displaying a valid blue badge. We do hold a valid badge and use this bay regularly, but it appears it wasn't displayed on this occasion, likely an oversight. The vehicle is used by multiple drivers, so we're unable to confirm who was driving at the time.

Are there any reasonable grounds for appeal in this situation?

There are number of things for you consider
If you were a customer of screwfix then speak to the manager to cancel with your explanation.
You could appeal as the RK do not name the driver under any circumstances. Explain that the blue badge was not displayed due to it having forgotten to be placed on the window or fallen down for e.g.
You need to send a copy to the parking company redact the issue number they don’t need that. Remind them of their legal obligation under the Equity Act To make reasonable adjustments.

Hi all,

I did appeal against the UKPC PCN and included a copy of the blue badge screenshots. I have since received this by email:

I also visited the Screwfix branch, but the manager said he was powerless when it came to the disabled parking spaces specifically, and that this would have to be taken up with UKPC directly. He did mention he could have intervened for the regular parking spaces, so that's good to know for the future.

I then managed to speak to a UKPC rep who was patrolling the car park at a seperate day/time. He suggested I appeal on the basis of a lack of signage at an appropriate height and location. He told me about new parking signs being fitted to the barriers, which hadn't been fully installed yet (see photo of a recently installed sign below). A sign had been installed on the disabled bay adjacent to where our car was parked, but not yet on the second disabled bay, with the rep noting this was apparently in response to complaints raised by visitors.

Does this strengthen our position? And any advice on how to respond to the letter above?

You can throw the kitchen sink in the appeal. The registered keeper can indicate that they have further information to assist in their decision making.

Under no circumstances name the driver I would email Screwfix  head office and state that they are discriminating against a person with a disability if they can intervene for a person without an apparent disability but not for a person with a disability

I received the below from Screwfix. They are suggesting it is outside of their control and down to the car park operator, and they can’t do anything about it.

I have yet to receive a response to my follow up appeal with UKPC.

Good afternoon

Thank you for your email regarding the Parking Charge Notice issued by UK Parking Control (UKPC) at our Chadwell Heath store.

I appreciate the concerns you have raised, particularly regarding the circumstances surrounding the use of a disabled parking bay and your comments relating to the Equality Act 2010.

The Parking Charge Notice has been issued in line with the parking restrictions currently in place at the location, and there is signage at the store advising customers of these requirements. As part of our review, can you please confirm whether a valid Blue Badge was present within the vehicle and clearly displayed at the time of parking?

It is important to note that Screwfix leases the majority of its store premises from landlords or managing agents, who independently appoint parking management companies to oversee and enforce parking restrictions. As a result, neither the store team nor the Customer Resolutions team has the authority to cancel, amend, or appeal Parking Charge Notices on behalf of customers, regardless of whether the notice relates to a standard bay or a disabled bay.

In response to your question regarding intervention, the same position applies irrespective of the type of parking space involved. Any decision regarding the issue, cancellation, or appeal of a Parking Charge Notice rests solely with the parking operator managing the site.

I understand you have already submitted a formal appeal to UKPC, including evidence relating to the signage at the location. As the parking operator is responsible for reviewing such evidence and determining appeals, we would encourage you to continue to pursue this process directly with them.

I look forward to receiving confirmation regarding the Blue Badge display so that we can ensure we have a complete understanding of the circumstances you have described.

Kind regards,
