PCN by PCM at my residential parking area

Hi All,

I need some advice regarding a PCN issued by PCM last night. My car was parked in the usual parking area, and due to the extreme heat, the plastic cover for displaying the ticket got slightly folded, along with the ticket. The ticket was visible, and its validity was only apparent if you paid close attention. They issued a PCN, although my car had been parked in the same place for the past three days. I have appealed to them and sent them proof that I have a valid resident parking permit, explaining why the permit was folded slightly. What are the chances of them accepting my appeal? After reading the reviews about them, I believe that they reject most of these appeals, and the IAS is equally biased in their approach.

If they take it to court, I have evidence that I did not park illegally, as I have a valid permit. Should I pay it or challenge it, as I don't think it's fair?

Do you have a lease, freehold, or assured short term tenancy agreement in which the terms and conditions for parking in your parking place are specified?
If so, despite claims by parking companies to the contrary, their signs can not overrule your contracts.
It’s unlikely but not impossible that your contract requires you to display a permit.

I have a tenancy agreement and have been living there for the past two years. You are expected to display a valid parking permit, which I did; however, the permit got folded due to excessive heat because the car's front screen was facing the sun directly. Another thing is that I have been parking there for two years.

I’m sorry but I think we need to see your tenancy agreement, with personal details obscured, in order to give you good advice.

What EXACTLY does your Tenancy Agreement say about "parking". What it doesn't say about parking is equally important.

It matters not one iota what someone has told you must do or what the signs say. Show us the exact wording in your tenancy agreement anything that mentions parking.

IN 99% of these residential parking cases, the operator has no authority to override the residents lease/AST and is operating unlawfully because the landlord or, more often than not, the management company have contracted the unregulated private parking firm without knowing the law surrounding supremacy of contract.
