Hi all,

The driver (which is not me, the registered keeper) got a ParkingEye PCN for staying at Lidl 2h29mn, as they were doing a 300£ shopping for a wedding. The max stay was 1h30.

About signage, I can only see old signage on google street view from a few years ago but it seems well displayed, although it states that the shopper has to enter their reg number after scanning their ticket, which a random comment in google review say might not be the case anymore. The driver did not do that but that is not the claim on the PCN anyway. 

We will contact Lidl to see if they can remove the PCN, and I don't think I have a golden ticket (mention of POFA but am I missing anything?). I am looking to appeal to give us more time, and not sure what I should be saying apart from the actual shopping. We can get a statement but it is neither in my name neither in the driver's name, just a passenger.

LIDL will be by far your best approach. Just tell them you took your time spending lots of money in their store.

The above is not actually true, Lidl manage their operator very tightly and set the appeals criteria. Appeal to Parkingeye with proof of shopping and it should be immediately cancelled.

Also in that thread, someone suggests that the NtK is not compliant with all the requirements of PoFA. Is that actually the case?

Whether the PCN is fully compliant is debatable and as far as we know not a defence that has been relied on in court which would be the ultimate arbiter for a specific case. The parking operator, Parking Eye will believe it is POFA compliant, some on here would disagree. There are better defences in many cases and claiming the PCN is not POFA compliant will not win an appeal with Parking Eye or convince Lidl to cancel it and it's unlikely to sway a POPLA assessors. Hopefully this will be quickly cancelled based on you being a genuine customer with proof of such by either Parking Eye or Lidl. Be carefully in your appeal to not identify yourself as the driver, you can refer to the driver in the 3rd party and the receipt should match the time and location of the PCN.

OP, let's get the facts please.

Did someone enter their VRM using the payment receipt as per requirements - we've all been there and know the ropes - OR did they not enter their VRM?

This is a rather important issue as regards any approach to Lidl i.e. spent £lots but took > max. permitted time (unsurprisingly) and entered VRM or didn't. AND, is the receipt timed slightly before the recorded exit time!

Thanks all for your inputs, some successful updates! I wrote to Lidl customer services and did the appeal in parallel. Lidl called me quite quickly (a working day later), and they would have definitely removed the fine but said that because I had appealed to ParkingEye directly, they can't do anything anymore and I have to wait for the appeal. Got the appeal answer today, and they removed the fine!

To answer the questions I hadn't yet answered, the driver did not enter any VRM, but these photos of the signage were quite old and I don't think it is still a requirement today. I couldn't get updated photos because I don't live nearby. The receipt is indeed timed just before the exit time specified on the PCN, which is a fact I definitely used on the appeal.
