APCOA Tesco Slough - failed to validate ticket

Hi chaps

Received a PCN as failed to validate the parking

Please see below (pics removed and detailed edited)







First time Ive ever got something from Apcoa within 14 days so that challenge is out

Consdering the following 2:

Any thoughts please?



Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

Dear Sirs,

I have received your Parking Charge Notice (Ref: ______) for vehicle registration mark _______, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012. There is no obligation for me to name the driver and I will not be doing so. I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

Both are fine. If you use the first one, delete “in the format” as no format is prescribed by 9(2)(f) and the point is that the warning is absent not that there is a warning in the wrong format.

Legally, they're pretty much the same as each other. It's a question of style and taste
