These are the two documents I received. I need to fill out the n180 form I think but I have no idea how. Would you like me to send all the pages of the notice? It’s about 5 pages document.

No. It’s only the dates personal to you we might need copies of. N180 by 7 April 2025.

Here are the answers to some of the less obvious questions:

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question.."

• F3: "1".

• Sign the form by simply typing your full name for the signature.

When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and info@dcblegal.co.uk and CC in yourself. Make sure that the claim number is in the subject field of the email.

Remember, you’re going through the process until DCB Legal gives up. There will be a mandatory mediation session at which you offer nothing and that’s it. Plenty of other similar case histories here.

All to be expected. The intention to proceed is a boilerplate response. The notice of allocation just confirms that the case is being transferred from the CNBC administration centre to your local county court. You will, in due course, receive a directions order from your local court which will give you the date of any hearing and deadlines for both parties to submit their Witness Statements (WS) and a deadline for the claimant to pay the £27 hearing fee.

DO not waste time trying to prepare a WS as the most likely outcome is going to be either a strike out by the case management judge or, barring that, DCB Legal will discontinue the claim just before they have to pay the hearing fee.

Morning, I just received date for telephone mediation. Any idea how to prepare for this?
Mediation is for 14/04/25
No other letter in the post yet just an email the tribunal service with a slot for telephone appointment.

No preparation needed.
Make it clear you are not prepared to offer anything to settle.
Do not get drawn into any discussion of your defence, refer any questions to the documents already submitted.
Just a tick in the box process. Person running the session is not a legally trained person.
Five minutes and it will be over.

Plenty of similar examples on this forum already.

Hi, just had the telephone mediation call and was offered to settle but as advised I just said I’m not prepared to settle. The caller then said if at any stage I decided to settle then I should contact the claimant.
She then emailed me this:

Although a settlement could not be reached on this occasion the parties are reminded that Court is considered a last resort and in which case both parties are encouraged to continue to communicate where possible in an attempt to resolve the claim, you may find that today’s mediation gives you both a base upon which to build on.

If the parties can satisfactorily resolve the matter without the need of the Court, the Claimant should complete a notice of discontinuance using the appropriate form in the link and file it with the appropriate Court; N279 - w3 Notice of discontinuance (6.99) (publishing.service.gov.uk) or update Online Civil Money Claims through your account.

If not already done so. the claim will now be transferred out of our business centre to a court where standard directions will be given and you will be notified in writing of the next stages to follow. It is important that both parties follow these instructions and adhere to the timetable set down by the Court which will include a further court fee and a final hearing for determination of the matter.

Hi there, it’s been a while since I had the mediation session. Nothing has happened so far. Should I be expecting anything else at this stage? I just don’t want them to come back years later with this again.

You just have to be patient. The case will be transferred to your local county court and you'll be notified when that has been done. You will also receive an order informing you of the hearing date, deadlines for the claimant to pay the trial fee and for submitting Witness Statements and anything else either party intends to rely on.

The order may also instruct the claimant to submit further PoC or it may simply strike out the claim. Just wait for it to come through.

DCB Legal will eventually discontinue on behalf of ECP before the trial fee has to be paid, if it's not struck out first.

Thank you. That’s exactly what happened. I received today Notice of Transfer of Proceedings.
This said that the Claim has been transferred to the county court for allocation.
The judge’s decision will be sent to me in a notice of allocation.
So just have to wait.

Hi there, so I received this email from Dcd legal asking again for settlement and frightening me about CCJ
what should I do please . So basically we’ve gone from £170 to £60. Do I stand my ground hoping that they will drop this or do I pay the £60 to put an end to this? What are my chances of ignoring them?

WITHOUT PREJUDICE SAVE AS TO COSTS
 
We write in respect to the above Claim and shall shortly be sending to you our Client's Witness Statement together with all documents in support of their Claim against you. This evidence will be presented at Trial, and we are confident that your liability for repayment of the Parking Charge will be determined by the Court.
 
Despite this, we have been instructed to attempt to settle the case with you so that the matter can be brought to an early conclusion and in order that you may avoid a County Court Judgment (CCJ) being granted against you, should the Court award this in our Client's favour.  They are therefore willing to settle the case at this stage for a reduced sum of £60.00. Should you be agreeable to the same, please ensure payment is made within 14 days of this email.
 
If payment in the above sum is not made within 14 days, we have instructions to proceed to Trial, where a CCJ could be granted against you. A CCJ can remain on your credit file for 6 years from the date it is granted, and its impact may make it difficult for you to obtain credit in the future, such as a mortgage.
 
Once paid we shall inform the Court of the early settlement, requesting the Trial be vacated and the Claim marked as paid. We shall then close our file.   
 
The benefits to you making a payment to settle the Claim at this stage are:
 
Avoid the case proceeding to Trial where you may have to attend.
Avoid the risk of a CCJ being granted against you and the impact this could have on your credit file.
Avoid the risk of further fees and costs being added to the amount you owe should the Claim proceed.

Stop worrying. There is no way you can get a CCJ. This is the first sign that they are going to discontinue. It's a well known tactic that we are fully aware of.

Do not respond to that letter. They may try and contact you again, either by letter, email of phone. Ignore all attempts by them to try and settle this. They have been known to go as low as offering £5. However if you stand your ground and follow our advice, they WILL discontinue.

As to what you cannot just get a "CCJ" read this:

• The recipient has 30 days to reply before a claim is filed.

No CCJ happens at this stage.

5. County Court Claim Issued

• If ignored or unpaid, the parking company may file a claim with the County Court.

• The court sends a Claim Form with details of the claim and how to respond.

• The recipient has 14 days to respond (or 28 days if they acknowledge it).

No CCJ happens at this stage.

6. Court Process

• If the recipient defends the claim, a judge decides if they owe money.

• If the recipient ignores the claim, the parking company wins by default.

No CCJ happens yet unless the recipient loses and ignores the court.

7. Judgment & Payment

• If the court rules that money is owed, the recipient has 30 days to pay in full.

• If they pay within 30 days, no CCJ goes on their credit file.

• If they don’t pay within 30 days, the CCJ stays on their credit file for 6 years.

Conclusion

CCJs do not appear out of thin air. They only happen if:

• A parking company takes the case to court.

• The person loses or ignores the case.

• The person fails to pay within 30 days.

If you engage with the process (appeal, defend, or pay on time), no CCJ happens.

So I received the below from DCB legal Ltd this morning:


We act for the Claimant in the above matter. 
 
Our client has instructed us to discontinue Court proceedings and close our file. Therefore, please find enclosed the Claimant’s N279 Notice of Discontinuance for your records. 
 
The attached has also been filed with the Court.
 
We will now proceed to close our file accordingly.
