Horizon PCN - Overstay - Vangarde Shopping Park, York

As registered keeper of the vehicle, I got a Parking Charge letter from Horizon yesterday relating to an overstay.

We went to see a movie, something we've done at this location before, but apparently there was some kind of event on (elsewhere, not at the location) which meant they were limiting parking to 2 hours (the movie was over two hours long). Nobody told us - especially when booking the tickets for the movie, which I'm a little annoyed about, and we didn't notice any signs. I was not the driver.

I'd like some help with finding an angle to appeal this, and I think I have the answer (Parking charge issue date is 13-Aug, which is 15 days from the breach date if we count breach date as day zero), I'm just looking for someone more knowledgeable in these matters to confirm that this is the answer, or if not, provide a better solution. Any help appreciated.

Easy one to defeat... as long as the unknown drivers identity is not revealed. There is no legal obligation on the known keeper (the recipient of the Notice to Keeper (NtK)) to reveal the identity of the unknown driver and no inference or assumptions can be made.

The NtK is not compliant with all the requirements of PoFA which means that if the unknown driver is not identified, they cannot transfer liability for the charge from the unknown driver to the known keeper.

Use the following as your appeal. No need to embellish or remove anything from it:

I am the keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. Horizon has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. Horizon have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

You should also send the upper management of the cinema a strong complaint about the fact that as patron of their business, you received a speculative invoice from an unregulated private parking company for £80. Explain that you will be warning everyone about this predatory tactic and that if they wonder why their sales are falling, perhaps they should have a word with the landowners managing agents and get them to restrain their agents as it is likely to affect their turnover in the long run.

Some strong statements in that text, I like it, and will use it as written if that's okay.

As for telling someone high up, I tried the "contact us" section on the website but I doubt that's going high enough. I will have a look around for something more substantial.

Start at the top. Find out who the CEO is and find an email address for them. They will delegate it to someone in their “team”.

As for the appeal, just use that exact wording. Thee operator is more likely than not to reject it but that is no surprise. As they are an IPC AOS member, the IAS is also unlikely to uphold that appeal but you never know your luck. Just this morning I saw an IAS appeal upheld. I told the appellant to go buy a lottery ticket.

If the appeal is not successful, then it is possible that it will end up at the ultimate dispute resolution service, the county court where a judge would decide whether you owe a debt or not.

The odds of it ever actually making it as far as a hearing are extremely low. The usual modus operandi for these scammers is to hope that you are low-hanging fruit on the gullible tree and will capitulate and pay up once litigation is threatened. They usually give up once they have to pay the trial fee and go looking for lower-hanging fruit.
