Author Topic: Help Please -- Group Nexus parking charge after parking in Budgens Wendover  (Read 597 times)

The driver hired a car for a weekend and stayed near Wendover and used the Budgens carpark on 2 occasions both times staying a little over 15 minutes ‘too long’.

Group Nexus sent charges to Europcar who then charged the driver £40 for each charge as admin fee

Europcar then forwarded the charges to the drivers address, by which time the opportunity to pay the lower initial charge had already expired.

The driver did not see any signage when parking that there was going to be the possibility of being fined.

For context, Group Nexus has now sent TWO of the following letters to the driver, so a total demand of £340. The driver has only just received this letter today (7th October 2025) and according to the letter below: “Please pay £170.00 within 7 days of receiving this letter to avoid us passing this on to our legal team to take further action” this gives the driver 2 days to respond before threats  of legal action.

Please the driver have some advice on this — does the driver need to pay? This seems like a hugely unreasonable amount considering the driver was not aware of these parking restrictions and has no recollection of seeing these signs when using the carpark - hence why it was used twice.

We think you should know that in November 2015 the Supreme Court made a ruling in the case of ParkingEye v Beavis establishing that a Parking Charge issued on Private Land is enforceable. The Court rejected claims that such charges are extravagant, exorbitant or unconscionable and advised that they act as a necessary deterrent for breach of contract. What the hire company sent was a copy of the Notice to Keeper (NtK) they received. The Hirer cannot respond to those NtKs as they are not addressed to them. The hire company transferred liability to the Hirer and GroupNexus will then send a new Notice to Hirer (NtH) which the Hirer can appeal against.

PCNs issued to hired/leased vehicles are the easiest to deal with as long as the Hirer does not name the driver. They are considered Golden Tickets as long as the driver is not identified.

I have no idea what kind of PCN you are referring to, NtK or NtH. If not NtH was received then something is amiss.

Even if anything were to happen over this, they still cannot hold the Hirer liable if the driver is not identified because GroupNexus PCNs fail to identify the creditor.

So, has the driver been identified? Was an NtH ever received after the copy of the NtK was forwarded by the hire company?

Hello, Thanks so much for for your reply.

The document I initially received - which was before the one I showed in my initial post - from Group Nexus is a Notice to Keeper, not a Notice to Hirer — it refers to me as “the registered keeper” and asks me to provide a copy of the hire agreement and a signed statement confirming the hirer’s details. No other documents were enclosed. (see appendix 1)

I’ve also obtained a copy of the email that Europcar sent to Group Nexus (Appendix 2). In it, Europcar provided my name and address as the hirer and said "the hirer who was driving the vehicle at the time of the offence" but stated that they would not disclose the rental agreement for confidentiality reasons. They simply confirmed that the vehicle was on hire to me during the relevant period and asked Group Nexus to redirect the notice.

As a result, Group Nexus never received the hire agreement.

To confirm:
• The only notice I’ve received is the one shown in appendix 1
• No hire documents were attached.
• The driver has not been identified (unless what Europcar sent counts as the driver being identified?)
• The only further contact after appendix 1 has been two “Legal A” debt-collector letters for £170 each.

Please could you advise on next steps, should I appeal the charge/ how do you suggest to proceed?

When your vehicle remained at this location, our cameras recorded it arriving and leaving at the dates and times stated on the right hand side. Because your vehicle stayed longer than the maximum stay period, having checked the vehicle details with Driver and Vehicle Licensing Agency (DVLA), we are writing to you because you were the registered keeper at the time of parking.
In accordance with the Terms and Conditions clearly and prominently displayed and agreed to when your vehicle parked on our Client's property, the payment of the Charge amount is required within 28 days from the date of this Charge. We will accept the reduced sum if payment is received within 14 days.
You are notfed under paragraph 9(2Xb) of schedule 4 of the Protection of Freedoms Act 2012 that the driver of the vehicle is required to pay this Parking Charge in full. As we do not know the drivers name or current postal address, if you were not the driver at the time, you should tell us the name and current postal address of the driver and pass this to them.
Once this information is received, we will pursue the driver.
