Group Nexus PCN - POPLA rejected appeal

Hi all,

I'm hoping someone could help me make a decision on whether to pay this fine or let it go to court in the hope the judge finds in my favour. To be honest the thought of receiving all the demand letters and to go to court without a guarantee I would win does stress me out. That's why I'm thinking of just paying it and putting it down to a bad experience, but it really angers me that these companies are getting away with things like this.

I broke down in a retail car park back in December. I called the RAC within the maximum time limit, but by the time the technician decided it needed to be towed to a garage, I had overstayed. I appealed to Group Nexus who offered the usual reduction to £20. I thought I had a good chance of being successful so I declined and appealed through POPLA. I now realise the POPLA are basically useless and have completely ignored all mitigating circumstances when coming to their decision. I don't know if I have a decent chance of a judge finding in my favour (maybe frustration of contract) or that I should just pay up now before I get more stressed and possibly shafted for more money.

If anyone can help or has experience of this and my chances please comment.

I think you need to read and act on https://www.ftla.uk/private-parking-tickets/read-this-first-private-parking-charges-forum-guide/ if you want informed advice.

“Frustration of contract” will probably come into it if you want to fight this.

Your post implies you’re going to pay up anyway. If you want our support, will you stay the course?

Thank you for the quick reply. I will have a read of that information.

I can see how my post gives the impression I will just pay it. I do want to stay the course to fight it, but I wanted some idea what my chances are. This is the first time I have had a PCN that I wanted to fight against.
