ECP NTD insufficient validation at High Wycombe Eden - driver name revealed in first appeal - lost cause?

Hi all,

Thank you for all the time and effort that goes into your replies - I have been reading any that I can find that might relate to my question, which is really 'is this a lost cause'? Driver name was revealed in the first appeal basically to extend the time - I now know since finding this forum that this was a mistake!

The driver parked in the Eden shopping centre car park in High Wycombe on July 17th 2026 at 13.04 until 17.12, validating parking at Buzz Gym. Unfortunately, this validation covers only 2.5 hours, which they did not realise at the time. Time was spent at the gym and other venues (with receipts). Another driver validated in the same manner but did not receive a notice. According to Eden's website, the barriers 'will not lift if an error has been made', so assuming all was well, the driver left the car park through the lifted barriers.

The NTK was received on ‎24 ‎August ‎2026 (although issued apparently on 22nd July 2026) - both the keeper and driver have been living at a temporary address during building work, hence not receiving sooner. A panic appeal (please see below) was sent just before the time ran out (actually after the 28 day deadline stated on the NTK). On this appeal, the driver name and address, as well as temporary address during building work with a specific request for follow up using this address, was made.

ECP also sent, on 21st August 2026, a Final Notification Letter to the registered keeper. There was no response to the original appeal, perhaps because this is now 'cancelled' by the NTD?

Also received today from ECP was the NTD, issued 31st August 2026. This was sent to the property that is currently vacant (despite request to send to temporary address), hence further delay. A second appeal was sent (please see below), again on 16th August 2026, despite the deadline stating 14th August 2026. Also just something to note, the only options on the appeal form are 'registered keeper', 'driver and registered keeper' and 'none of the above' - the last one was selected on the second appeal, since the driver and keeper are different people.

So, I am wondering, is there any recourse, or should I just pay it?

Thank you in advance

Specific wording on appeal 1:

I am the registered keeper, not the driver. I received this notice today 22/08/2026. We moved to a temporary address in May 2026, the property has been vacant since this time due to extensive building work taking place. Having returned to check the property, I discovered the letter & am appealing at the first opportunity.
The driver is XXXXXX. Please send correspondence if by letter to: XXXXX ( temporary address until approx. September 2026).
Additionally, as a patron of the Eden Centre, the parking was validated & the barrier opened when exiting - which shouldn't happen if payment is required. A witness parked for a longer period also validating at Buzz & was not issued a notice.

Specific wording on appeal 2:

I received this notice 16/09/2026, appealing at 1st opportunity. As advised, I moved to temporary address in 05/2026, property is vacant due to building work, SEND CORRESPONDENCE TO: XXXXX (until end Sept 2026 at least). Sending to an address while aware I won’t receive the letter is highly suspect.
Parking was validated & the barrier opened when exiting - which shouldn't happen if payment is required, according to Eden’s own website. A witness parked for a longer period also validating at Buzz Gym & was not issued a notice.
