I was about to prepare a defence to the Claim form I received from Euro Car Parks Limited / DCB Legal and came across this excellent forum. I would appreciate your help / thoughts
The PCN was originally issued 15/03/2022 alleging the "vehicle being parked longer than the maximum period allowed" at Priory Retail Park, Colliers Wood, London. From googlemaps streetview, the stated maximum period is 2 hours on the signage, although this is not stated in their NtK to me, just the alleged ANPR entry and exit times.
The driver parked up, visited the shops in the retail park, bought items (receipt available), got back in the car and left the retail park. As the registered keeper I subsequently received the PCN.
Since the issuance, I have made no representations or acknowledgement of the PCN, Debt Recovery Plus Letters, Terminal notices, "case monitoring letters" etc or the Letter of Claim from DCB Legal.
The issue date on the Claim Form is 08 Apr 2025; I have submitted an AoS on 23/04/2025 at 07:55:44, received 23/04/2025 at 12:05:27. I believe I therefore have until Sunday 11th May to submit my defence.
I have attached a PDF containing:
1) The Notice to Keeper
2) The Letter of Claim from DCB Legal
3) The Claim form in the CNBC
I appreciate your time, thoughts and any assistance in preparing a suitable defence
