Got a Northampton court letter for a potential ccj.
I have received a court form that a parking firm wants to claim off me for a unpaid pcn. My car was being driven by another driver at that time. I received the pcn In sep 24. I appealed by letter/post as it stated behind the pcn, stating I was not the driver and gave the drivers information. I have had no response. I received further letters weeks after and always responded to refer to my original letter. No responses were ever made to my original letter. My last letter stated I would no longer be responding as I have responded before several times stated the drivers details. I have made about 3-4 responses and I made sure I had photocopies. Now I got a court form stating they are trying to collect the outstanding. What are my chances of winning now or getting this case dismissed. They have never sended any letters to the driver who was driving.

Please post the claim form you have received from the court - redact name, address, claim no and MCOL password. Leave the dates visible. Providing it's the usual rubbish from DCBL or Moorside, then it should be easily defendable.

If you gave them a name and a valid address for service of the driver, you have no further responsibility.

and post all correspondence, suitably redacted but don’t obscure dates or times.
Clearly the discussion about referring to the driver in the third person is irrelevant in this case.
As long as you show us the appropriate paperwork and follow our advice you will not lose. Your case is solid and if they insist on taking you to court we can advise on the paperwork to ensure you don’t mess up.
You can only get a recorded CCJ which affects your credit rating if you lose at court, which would only be by incompetence here, and you don’t pay up within 30 days. They will try and scare you with words like “potential CCJ” in big red letters, but it’s not going to happen.
