Gemini Private Parking - No Signage - Debt Recovery Plus

Hello all,

My husband got a suprise parking ticket back in Feb 2024 through the letterbox for unpaid parking, he returned to the scene of the crime to investigate and Unfortunately on discovery realised some travellers had moved into the car park and ripped down all signage that:
a) indidcated it was a paid car park
b) any instruction on how to pay
He appealed this with Gemini and provided plenty of photography evidence to indicate there was no appropriate signage. They denied this appeal, he appealed with them again and subsquently they just ignored him... so he put it to the back of his mind.

Fast forward a year, he just recieved a letter in the post from Debt Recovery Plus indicating this was his 4th letter (but actually his first) for debt recovery for £170.
I've researched into debt recovery plus and see this is just a scare mongering tactic of theirs however, unsure what action to take, is someone able to advise?
Obviously doesn't want to pay £170, does not even feel he owes the initial charge of £60 but also doesnt want to risk it going further. Does anyone else have any experience with these companies?

Ignore Debt Recovery Plus, as you say.

If/when you get a Letter of Claim then come back here for advice.

Your husband can not have entered into a contract without clear signage or no signs, and he has the pictures, no contract means no money owed.

Gemini and their ilk don’t care, if they refuse appeals many people just pay up, which is what they want.

If you’ve changed address, be sure to inform Gemini of your new address, you don’t want to miss important paperwork.

The initial charge was never £60. It was always £100 with a "mugs discount" of 40% if you didn't bother the operator with requiring them to reject the initial appeal.

As already pointed out, ignore useless debt recovery letters. Debt collectors are powerless to actually do anything except to try and persuade the low-hanging fruit on the gullible tree to pay up out of ignorance and fear.

Come back when you receive a Letter of Claim (LoC) and we will advise on how to deal with that and everything else.

You don't owe Gemini a debt unless a judge says you do and I will bet £100 that this will never get anywhere near a hearing before it is either struck out or discontinued.
