Gemini Parking Solutions Newham Hospital

Received a ticket on site at Newham Hospital

I have a relative who was rushed into A&E and has sadly been give a coupe of days to survive

I am a disabled driver with a blue badge which was displayed at the time (you can see it on the dash in the photos)

You can see from Gemini's photographic evidence that my parking isn't great (to be honest) but that was the only space available and time wasn't really on my side

This is their appeals portal where you can view the photos

This is the ticket

Thanks in advance

PALS at the hospital should be your first port of call

Try PALS - they are excellent in matters like this.

This is the response I received from PALS

I am very sorry to hear of this experience and wish to apologise on behalf of Barts Health NHS Trust for the upset, distress and inconvenience caused to you all.

We value all feedback and take issues and concerns very seriously.

I am afraid any parking concerns need to be raised directly with the Gemini Service on the contact details provided on the back of the issued ticket. PALS do not manage any parking concerns as this is out of our remit.

I am sure Gemini will be able to look into this matter and assist you with this penalty.

I emailed PALS highlighting that. as the Landowner, the Trust had the power to cancel the ticket at their discretion and I got this reply. I know Gemini will reject any appeal but do I just follow the process?

The Parking Services have informed, the process is you initially must make the appeal with Gemini and await their response, have you made this appeal?

If you have and are unhappy with their outcome decision than you can raise this with the Trust.

What grounds do I appeal on or do I wait for NTK?

"I am sure Gemini will be able to look into this matter and assist you with this penalty."

Very sloping shoulders reply and it is not a penalty.

If PALS have been unhelpful/evasive then you email the NHS Trust CEO with a formal complaint about both the parking operator and PALS. You can remind them of this document:

https://www.gov.uk/government/publications/nhs-patient-visitor-and-staff-car-parking-principles/nhs-patient-visitor-and-staff-car-parking-principles

Especially the "Contracted-out car parking" section.

On a separate note, absolutely no one pays a penny to ECP if they follow the advice we give here, even if it goes all the way to a county court claim.

I have already highlighted the principle to PALs inc the link above but they didn't want to know
Will escalate to the complaints team
