The car park is owned / provided by Kent County Council and this is why the ECP NtK is not PoFA compliant - they don't even mention PoFA.

You have missed the appeal deadline so you now have to play the long game.

Never reveal the driver.

There is no way to keeper liability in this matter so rest easy.

Thank you for your reply.

I am not sure if the land is covered by byelaws or not. How would one find this out?

You can use this tool that I developed to check if you have grounds for appeal. You can check the postcode of your PCN and if grounds for appeal are found, a custom template can be downloaded. It is totally free as I am trying to launch it. Hopefully it won't get me banned. I am trying to help.

I'll get photos tomorrow and post up.

On a side note, I just received a private message linking me to a website www.ninjapcn.co.uk where you type in the postcode of the car park of the PCN, this one is CT21 4HL, and it tells you automatically if the PCN is valid and or appealable.

I did this and it came back with:

"🛑 Deadline Alert: You are more than 28 days past the issue date of your PCN. A formal POPLA/IAS appeal is legally timed out.

How is this even fair if the PCN was issued 11th April and I only received the final notification 2 days ago!?!? That's crazy. There must be a formal appeals process. Please help!
As I said before I'll post pictures when I get a chance tomorrow.

You don't need any photos.

You now have to wait to see if they pursue the matter further.

There is nothing further to do at this point in time.

You are now waiting for a 'Letter Before Claim' which we can then respond to.

Hi there, it is worth trying to appeal even if the deadline has passed. Just put the date of your final notification and download the template...then follow the steps. Good luck!

You could try an appeal on the basis that the original PCN was not delivered and that first knowledge of the situation came from the reminder.

I would ask ECP first if you can appeal before you reveal the appeal details.

So I haven't received any "letter before claim" or any NtK. I've received a debt recovery letter. So I've received one letter, and one debt recovery letter. They claim they had sent a 2nd letter when I requested the FoI request but I never received it. So, I feel like I haven't even had an opportunity to appeal.

Where do I go from here please? I'm at a loss. I don't feel £170 at all fair and the small amount of time before palming the feeling off to a debt collection agency already?

Please see 2nd and most recent letter.

That's just a hopeless begging debt letter.

You are still waiting for a Letter Before Claim.

Nothing to worry about - they are trying to hustle you.

As always, I'll post back here with any updates.

Hello. Me again. Received another letter in the post today:

https://postimg.cc/gallery/MXyt8kX

No mention of how to appeal. Again, do I just keep waiting until I receive something like a NtK?

What are the next steps? I haven't been able to appeal because apparently, i missed the deadline which is crazy as I didn't receive any letter in time to appeal and it went straight to debt collection.

Any assistance would be greatly appreciated.

Many thanks,

You won't get a Notice to Keeper. That's in the past. You are getting hopeless begging letters from debt collectors that you can ignore. You can't appeal.

Debt collectors are trying to frighten you into paying. You either follow our advice and ignore or you pay them and they will stop.

Letter Before Claim.

Thank you I'll wait for this. And again, as always, I'll post back if I receive anything else.

And if it's a Letter of Claim, it's the same thing. Don't get hung up on the precise words.
