Hello,

I received a fine 15.01.25 and have ignored all of the letters since then, including letters from DCB legal threatening bailiffs and court action.
Yesterday I received a letter from HM Courts and Tribunal Service that someone is claiming that I owe them money, if I do not respond a CCJ may be claimed against me.
Can someone please advise me on how to respond?
I have an admission form or defence and counter claim.

Any advice very gratefully received, TIA.

I had bought a ticket, but stayed 20 minutes past I believe and could not see a way to extend and didn't know if buying a new ticket would rectify it so just left. Also could not see any contact numbers in the car park.

Please post up the claim form and the original PCN redacting only personal details and passwords.

As the N1SDT form says, you have 5+14 days from the date of the form to submit an Acknowledgment of Service or a defence. If you do the former you have a further 14 days to file a defence. Seeing the letters as requested may help us to help you with the defence.

It’s not a “fine” and the word will not appear on the claim form or elsewhere.

You will defend in full and not counterclaim.

Or you will pay, because the driver exceeded the 10 minute “grace period” significantly, under the contract the driver entered into by reading the signs and parking.

In the worst case, please understand that if you go to court and lose, no judgment will be recorded against you provided you pay within one month.

As an addition from a long posting member (b789) says it may go all the way to a court but the will most likely discontinue before paying the court fee.

Can someone please advise on how I can post images as I cannot see this option - I do not have the original PCN anymore but can share the claim forms and a letter from DCB.

You should consider submitting a Subject Access Request promptly (https://ico.org.uk/for-the-public/getting-copies-of-your-information-subject-access-request/) to obtain the documents you no longer have. If you are quick enough you might obtain a copy of the PCN prior to your defence submission deadline.

You are advised to remove the password from the N1SDT front page you have posted. Otherwise some person with malicious intent could log on as you and mess things up for you.

I will now submit a subject access request, should I respond with the acknowledgement of service in order to receive 28 days rather than 14 to prepare defence?

Of course, you will need the full 28 days.

Gives you until 25 March I believe.

Thank you so much for your help so far Jfollows. The SAR is sent and I have the acknowledgement of service ready to send in the post first thing tomorrow. Can I post any responses here for further guidance?

You should definitely post any correspondence, it will do no harm.
You should also search the forum for “DCB Legal” and responses to their generic N1SDT forms in the meantime, so you have some kind of defence ready to file by the deadline.
Ideally there will be an identifiable failure in the PCN if you get it in time. It is invariably the case that those from ECP can be challenged.

You should file the AoS using MCOL for simplicity. No need to post.
