Hello,

I have recieved a court summons for a PCN in Nov 2020. - attached.

I have no recollection of this and have just recieved a summons in the post. I don't even own the car anymore, I was the registered keeper but 3 people were named drivers on this car.

I do remember seeing a post around the time on a local Facebook group that the car park (which was very new) had charged a lot of people. It made the local paper and off the back of that the time was exstended from 90 minutes to 150 minutes.

Please could I have some advise on how to defend this. I intend to dispute it. I have moved house twice since the alleged claim but the DVlA was updated both times. I'm wondering if that was why I've had no correspondence, I've been in this house for 2 years though.

You have not received a summons. This is not a criminal matter. You have received a county court claim for an alleged debt, from ECP, issued by DCB Legal.

What is the “issue date” of the claim?

This is very easily defended and I can say with better than 99% certainty that they will eventually discontinue.

You say that you updated your address with the DVLA. Did you update both your drivers licence and the V5C? Updating one does not update the other. Is the N1SDT claim form addressed to you at your current address or has it been handed to you from somewhere else?

If it is addressed to you at your current address, then that is ok. If it isn’t and you did not receive any Pre Action Protocol correspondence such as a formal Letter of Claim (LoC), you will have even more for your eventual defence.

Thank you so much for your reply. I didn't get an email.alert unfortunately.

 Apologies I will try and amend my header to the correct information.

The issue date is 21st November 2024.

Yes I updated both. It's addressed to the correct address.

I'm currently suffering from Hypermesis and I've been very very poorly. I foolishly did not respond to the letter and recieved a new letter from DCb legal today advising of a ccj and a payment with in one month to remove.

I've attached the letter with personal details removed.

Sorry to ask again, is there anything I can do from here or will I need to bite the bullet and pay? I can prove the prescriptions and doctors notes how poorly i have been. I was in no fit state to sort it.

Unfortunately you did not acknowledge or defend the claim and a default CCJ has been issued against you. If you pay it in full within 28 days, it will be expunged from your credit file. If you don't pay it within 28 days of the judgment (13th January), then it will remain on your credit file for 6 years and will cause you untold financial pain.

You had until the 3rd December to Acknowledge Service (AoS) which would have given you until 24th December to submit your defence. By not submitting an AoS, you were in danger of receiving a default CCJ from the 4th December. They didn't push the button until 16th December.

Had you done the AoS and submitted a defence, you would not have had to pay a penny to ECP. The claim would have been discontinued.

Now you are financially out of pocket. You could pay £303 for a set aside with no guarantee it will be accepted by the court and you would still have to defend the claim.

Hard lesson to learn.

I'm more frustrated at the unjust of it.

It makes more sense to pay the amount now than waste the time and effort to fight it.
