APCOA PCN - No Permit - Loughborough University

Upon entering the car park, the driver found a space and parking was paid for on the app. There were separate signs saying parking could be paid for on the app, and another saying permit holders only. The driver mistook this to mean that you could park as a permit holder or pay for parking.  Please could you advise of the best way to appeal this? The registered keeper received a PCN today in the post.

I have also attached the photo of the back of the PCN and some photos of the signs. I would be grateful if someone could advise how the appeal should be worded. Thank you.

The PCN looks like its still in the within 28 Days Appeal time.

Thank you. A lot of the APCOA appeals I've seen are from airport parking, so I'm not sure if the same wording applies in this case.

Out of interest, what's the issue date of the notice? (I.e. the date it was posted, not the date of the parking)

My suggestion would be:

Dear Sirs,

I have received your Parking Charge Notice (Ref: ________) for vehicle registration mark ____ ___, in which you allege that the driver has incurred a parking charge. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act"). You have chosen not to issue a Notice to Keeper in accordance with The Act, and it is now too late for you to do so.

There is no obligation for me to name the driver and I will not be doing so. I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

If appealing online, be careful there are no drop down/tick boxes that cause you to identify who was driving, and keep a close eye on your spam folder for their response. If they do not respond within 28 days, chase them.

Thank you, the issue date is 21st Feb, but was received on 27th.
