CCJ Sent to address not where my car or licence is registered

Hi can someone please help me with a CCJ i received. I accidentally found out about it as my mum visited my property which i currently do not live in and gave me the letters i received regarding a parking ticket i had in 2018/2019 and as they had not heard from me had gone to the court to issue a CCJ. My car is registered at the same address in which they have stated that the original ticket issuer sent me mail in 2018. The company who is now chasing me stated that no other attempts were made to contact me since 2018 until now in 2024. This company sent letters to a property I own but do not live in (not sure where the got this address from) and not to the address that my car and driving licence is registered to. Are they allowed to do this given that my driving licence and car is registered at an address that they did not attempt to send correspondence to in the last 5/6 years (since they claimed to have sent me a letter at this address). What can I do to contest this as i now have a ccj on my record?

Your drivers licence and V5C are not linked in any way. If you update your drivers licence, it does not automatically update your V5C, which must be updated separately.

So, physically go check now. Please confirm whether the address on the V5C is correct and was it correct at the time the PCN was issued (not the court claim).

If the CCJ was issued by default because you never received the claim due to it being served incorrectly to an address you did not reside at, then you can apply to have the CCJ set aside under CPR 13.2, which is a mandatory set aside.

There are other arguments which will depend on the circumstances  of the original claim and even if set aside, may be allowed to be re-served. However, there is also a good argument to have the original claim struck out.

Do you have a copy of the Particulars of Claim (PoC)? If not, you need to phone the CNBC and ask them to email you the PoC while you wait on the phone. Be prepared to wait for a while. Call first thing in the morning around 0830 for the best chance of a shorter waiting time.

Also, ask them who the Claimant is and which, if any solicitor represented them.

You must act promptly when discovering a default CCJ and any delay in applying to have it set aside will be questioned by the court.

You will need to file an N244 application for the set aside. There are two options, an application with consent which will cost £119 or without consent which will cost £303. The difference is that with consent is by agreement with the claimant and does not require a hearing. However, the claimant has to agree and is unlikely to agree to paying you back the £119 application fee. Without consent means that you are applying for a hearing and are able to request your £303 application fee be paid by the claimant, especially if they can be found to have acted unreasonably by not being diligent in trying to find your actual place of residence.

You will be required to submit a Witness Statement and a draft order for the set aside and also a draft defence for the original PCN. You seem to be aware of having received the PCN back in 2018/2019.

At the time of the CCJ, were you there to be found? Were you in the electoral roll? Do you have utility bills in your name at the location you reside at? Do you have a bank account in your name with your current address? In other words, would any credit reference agency be able to find your current address for the sake of a bulk credit reference search?

They can only request registered keeper's details for the date of the parking event, if your car was registered to that address in 2018 and you still own the property (so would show on a trace) then I would suggest they had no reason to serve a claim elsewhere.
There are motorists who have been scammed and those who are yet to be scammed!

So you've contacted the enforcement agent company, let's call them bailiffs.

How, what transpired?

The rest is a little unclear.

The car is and was at the time[to be confirmed by you] registered to address A.
The 'original ticket issuer' [let's call them the creditor] sent their notices to this address in 2018.
The bailiffs sent their letters to address B - a property you own but do not live in- not address A.

Using the above notation, pl just give us a timeline:
Car registered at address A when alleged breach occurred;
All notices sent by creditor to address A;
None was responded to by anyone;
Bailiff sent their enforcement correspondence to address B.
You live at address ?

for more details :

The car is and was at the time in 2018 registered to address A.

The bailiffs sent their letters in the year 2024 to address B - a property I own but do not live in- not address A.

Car registered at address A when alleged breach occurred; 2 notices sent by creditor to address A; None was responded to by anyone; in 2018
Bailiff sent their enforcement correspondence to address B in 2024
I live at address A and my car has always been registered to address A , so i did not know a CCJ had been issued as Bailiff sent all correspondence to address B

I own address B but have not been living there for a number of months and no bank statements are registered to address B, neither am I registered for voting under address B so very unlikely that credit reference will contact me using address B , which is why i find it strange that Baillif sent letters to address B.

I am very overwhelmed with this CCJ and i feel like i might just have to pay the £100s of pounds associated with it as the N244  application sounds like it will result in more costs.
