Author Topic: DCBLegal taking me to small claims court. I have credit card evidence I paid them for parking  (Read 892 times)

Hi there, I wonder if someone could help.

I've been ignoring a string of parking fine final reminders, as I paid for the parking ticket with my credit card which shows up on my statement as Euro Car Parks Limited with a deduction of £2.

They filed a claim at the small claims court in Runcorn (the alleged offence took place in Hounslow, West London). I received documents from the court and I sent back the forms needed to dispute the claim with an issued statement from my bank of the debit of £2 included.

That was a bit more than a month ago. I then received an email last night from DCB Legal saying they were going to continue pursuing the claim, attached with a PDF of a N180 DQ filled in for them to be at court. It's signed "DCB Legal Ltd"

Now I haven't received anything from the court themselves yet and I am wondering if this is a last gasp at trying to get a settlement?

Runcorn is an extremely long way for me to appear at trial.

Any advice would be appreciated.

Search the forum. It’s littered with DCB Legal.

DCB Legal almost always discontinue in the face of a defended claim.

In the unlikely event they don’t, the case will be held at a court local to you according to the N180 you will submit in due course.

Plus their DQ needs to be challenged if no person signed it.

They didn't file any claim in "Runcorn"!!!!! That is their postal address. Do not try and paraphrase stuff you are unfamiliar with. Post an image of the N1SDT Claim for with the Particulars of Claim (PoC and also the back of the form with the name of the person who signed it.

What exactly did you submit as your defence?

Whilst the odds of this ever going as far as an actual hearing are slim to none, if it ever did, it would be at your local county court, not the one near DCB Legal.

Check your MCOL history and when you see it updated to show that your N180 DQ has been sent, you can complete these instructions:

Here are the answers to some of the less obvious questions:

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question

• F3: "1".

• Sign the form by simply typing your full name for the signature.

When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and info@dcblegal.co.uk and CC in yourself. Make sure that the claim number is in the subject field of the email.

...which is why I assumed it would be in Runcorn.

I filled in the two forms the HM Courts sent me, to say I was disputing the claim. And also provided a printed credit card statement I had asked the bank to send me on headed paper, underlining the the £2 debit.

I don't have a copy of those forms I can provide here. I only have the cover note and the Admission form left.

I signed up to MCOL just now and searched for the case number on the DCB Legal pdf, which came up "No case found"

That's because you are looking THEIR copy of their N180 DQ. If you read the instructions I gave you, you will need to send your own N180 and you will copy that to DCB Legal.

Yes those instructions helped me understand what I was looking at, what I will do when/if I get a N180 from the court. And what I should have done with the forms the court sent me.

I'm sorry, I don't know what a PoC is. The only documents I have left from the court is the Admission form, which I didn't fill in and a cover note.

I wrote something along the lines (and I have to paraphrase here from memory) That "I had paid the parking charge and displayed the ticket on my dashboard. Here is my credit card statement with the Euro Car Parks Limited debit underlined. Transactions appear the day after on statements. They can cross reference my credit card number with the machine on the day. I hope this puts an end to this."

I do have a Notice of Debt Recovery sent by DCBL before the court contacted me, which is signed in pen by Kim Heaton, but I don't think that's what you asking me for.

I don't remember exactly what was written on the N1SDT from the court, but it would have been similar to what was written on DCBLs last recovery letter they sent me... "Reason for Contravention - No valid pay and display/permit was purchased"
