Check your MCOL history. What does that say?

After the mediation call, the claim is then assigned to the small claims track and allocated to your local county court where a case management judge will look at it and issue orders which may include striking out the claim or ordering more information or simply assigning a hearing sate with deadlines for the claimant to pay the trial fee and deadlines for all parties to submit their evidence in a Witness Statement.

In DCB Legal issued claims, they will usually discontinue just before that have to pay the trial fee.

It says it was transferred to my local county court, on 21/03/2025.

There's nothing after that.

There won't be anything on MCOL once the case has been transferred to your local court.

You need to contact your local court and ask them why you have heard nothing.

I did have a letter from CNBC, about the claim being allocated to my local county court, and that the judge's decision will be sent in a notice of allocation.

But nothing from the actual court, with the above. Should I still contact them, or give it more time yet?.

If it has been more than ~6 weeks, then yes, you should contact your local county court (or wherever the claim has been assigned) and ask them what is the status of the claim.

It means that the claim is struck out. However, the judge has thrown the claimant a lifeline by allowing them to submit further PoC to be received by the court no later than 4pm on Friday 16th May. If they fail to do so, the claim is struck out again.

However, if they do submit further PoC by the deadline, you then have until 4pm on Friday 30th May to submit an amended defence.

So, for now, we wait and see whether they submit further PoC or discontinue. Either way, you either win or get a second stab at defending.

I got a letter today from DCB Legal. Saying their client, would be willing to settle for £80. It say's you have 7 days to confirm, otherwise they will continue to follow the court process.

I take it, I just ignore this right?.

Ignore. First indication that they are going to discontinue.

So the deadline for them to submit further PoC has passed.

Will I have to contact the court, to see if they submitted anything, or will I just receive a letter?. Do I need to just sit tight and wait?.

Thanks again.

Which county court has your claim been transferred to? Hiding this data makes it impossible to advise on where to send the following email.

Send the following by email to the court making sure you include the claim number in the subject title and "URGENT" and also CC in info@dcblegal.co.uk and yourself:

Claimants Failure to Comply with Court Order – Request for Confirmation of Strike Out

Dear Sir/Madam,

I write with reference to the Order dated 16 April 2025, which required the Claimant to file and serve a further statement of case by 4pm on 16 May 2025 (paragraph 2), failing which the claim would not proceed.

As of today’s date, I have not received any such statement from the Claimant, nor have I been notified of any application for relief from sanctions having been made or served.

I would be grateful if the Court could confirm whether the claim is now struck out in accordance with the terms of the Order, and whether any further steps are required from the Defendant at this stage. In particular, I seek clarification as to whether the requirement at paragraph 4 for the Defendant to serve a further statement of case by 30 May 2025 still stands, given that it was contingent on the Claimant's compliance.

I have copied in the Claimant's representative for transparency.

Yours faithfully,

[Your Name]
