Hi :) so clearly dcb legal think they can take this further....we have received N180 from court. I have made few searches in this forum and thought about completing our own electronic one from https://assets.publishing.service.gov.uk/media/673341e779e9143625613543/N180_1124.pdf ?

Also for the form use the following as advised in other post -

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question.."

• F1: Whichever is your nearest county court. Use this to find it: https://www.find-court-tribunal.service.gov.uk/search-option

• F3: "1".

• Sign the form by simply typing your full name for the signature.

When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and info@dcblegal.co.uk and CC in yourself. Make sure that the claim number is in the subject field of the email.



The only thing that I am not sure about - we have the evidence form bank that payments were completed for parking on both days. Do I mentioned this anywhere or leave it for the future should this go past mediation stage?

This is never going to get as far as a hearing. Keep all your evidence for the extremely unlikely situation where they do submit their own witness statement and then you can rebut anything in there with your own evidence.

For now, their claim is defective and you are unable to plead a proper defence because of their incompetent PoC which do not adequately comply with CPR 16.4.

Your evidence from the bank you leave for now, you have already submitted your defence. In the unlikely event that this actually goes to court rather than being discontinued you can include it in some way in your Witness Statement, but it’s more likely that the case will be discontinued before you need to file one.

Does this mean I completely ignore N180 or fill N180 and state the above please?

You file your N180 as you have already identified above.

Nobody has advised you to ignore anything!!!! Where on earth did you get that silly notion from?

You complete your own N180 DQ when it comes and you go through the waste of time mediation call. After that the claim will be transferred to your local county court and you will receive directions from a procedural judge which you should show us so that we can then advise on deadlines and when you can expect the claim to be discontinued.

This process will take many months to complete.

Thank you. Silly me misread the claim defective bit and misunderstood it :)

N180 completed and sent to court. Further waiting game in place then :)
