Yes.

But there's a bit to happen before that.

As I mentioned before, Moorside would have been hoping that you didn't bother entering a defence so they could claim a default judgement.

We estimate that 80% - 90% of parking claims go un-defended (or get settled before Court) so it's a statistically beneficial business model for them and this is the only reason they exist.

Moorside are not set up to actually go through with the vast majority of these cases - in simple terms they are serial litigators who are only interested in the numbers game.

This is now a defended claim so you just created a mountain of 'paperwork' for them.

They will probably carry on with the game for a while and then discontinue.

Thanks. Does it matter that the solicitors in this case are DCB Legal though? Not Moorside.

Anecdotally we see more Moorside cases actually go to a hearing than we do DCB Legal ones.

My advice is always to proceed on the assumption you'll have to go to court, and if they do discontinue beforehand, great.

Hi everyone, thanks for your help this far.

Email from DCB Legal received re N180. I've had nothing from the court so far. Do I just fill out my own blank N180 and file that through the online portal? I take it I shouldn't call them about settlement? I've read elsewhere people being advised to refuse to engage with mediation. Does that apply to me too?

Thanks.

Good Afternoon

Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim.

In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.

Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence.

If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.

Kind Regards,

Litigation Support

Check your MCOL status, and send your own N180 when it says that you’ve been sent one to complete. Yes, send it online and search the forum for advice on its completion if you’ve not already seen it. Read the N180 form and you will see that mediation is mandatory; again search the forum for advice. Never call DCBL or DCB Legal because you want all communication to be in writing so you have a record. In due course they will call you and you should hang up and block their number if so.

MCOL claim history now shows that the DQ was sent to me on 7/7/26, which I've received in the post. Twice actually.

The problem is there doesn't appear to be any way to submit it online instead though!?

What do you mean?
Search the forum for “N180” and you will find many, many examples and guidance.

Search the forum for N180 and you’ll find advice on its completion, such as:

Having received your own N180 (make sure it is not simply a copy of the claimants N180), do not use the paper form. Ignore all the other forms that came with it. you can discard those. Download your own here and fill it in on your computer. You sign it by simply typing your full name in the signature box.

https://assets.publishing.service.gov.uk/media/673341e779e9143625613543/N180_1124.pdf

Here are the answers to some of the less obvious questions:

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question.."

• F1: Whichever is your nearest county court. Use this to find it: https://www.find-court-tribunal.service.gov.uk/search-option

• F3: "1".

• Sign the form by simply typing your full name for the signature.

When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and info@dcblegal.co.uk and CC in yourself. Make sure that the claim number is in the subject field of the email.

Sorry, I thought I'd replied to the last post.

Thanks. Figured out how to submit it online. I've now started getting calls from DCB Legal, I get a prerecorded message and hang up.

Just got off my mediation call. Asked the questions below as per another thread, with the answers included...

1. the full name of the person attending for them: Dion James
2. their role/position at their legal representative’s firm: Small claims mediator for HM Courts & Tribunals Service.
3. whether they hold written authority to negotiate and settle today: no, he said he had no authority to negotiate or settle and was calling just to mediate and present offers to the involved parties.

I told him my settlement offer is £0, or I invited the claimant to discontinue with no order.

Thanks for all the help.

Do I now wait for a court date / discontinuance?

I think the questions were intended for the claimant’s representative, but that’s no matter, I also think the issue of claimants potentially using unqualified people to act has gone too.

You will eventually get a court date for a hearing in the court you specified in your N180 form, along with dates by when the claimant has to pay the court fee and dates by which both parties have to submit papers in advance of the hearing. Show us the details when you get them and we can advise.

You will also get more calls from DCB Legal unless you have now blocked their number, trying to “settle” with you in advance of the court hearing. Ignore.
