Hi
The mediator called this morning and I used your advice.
The mediator tried to take certain sentences I used over to the party after he asked me questions about the case this far.
I instructed that the only thing to take over to them is that "I wish to pay £0.00 and have attended the call as asked".

Hopefully this works. It was all very scary and uncertain. But, I hope this course of action does keep me out of court and sees them run away with their tail between their legs.

Thanks again for your assistance to date.

The mediator called back shortly after the first phone call to state that DCBL would be happy to settler out of court for £80.00. I stuck by my guns and said I offer £0 zero pounds and have attended the mediation meeting.

Literally as you predicted, they are lowering their offer substantially presumably to remain out of court.
£250 1st offer to £80 second offer is quite a jump down.

Thanks again.

Stick to your guns. They will keep trying to contact you to settle for ever lower sums until they simply discontinue the claim. I have known people to have a bit of fun with them trying to see how low they would go and I think the record is £5 and they were still told where to shove their offer.  ;D

Hi @RetroRick

I know this is an old thread, but I just wondered what was the eventual outcome of this case. Did the claimant eventually discontinue after your mediation call?

I'm currently embarking on this exact same journey. I've only recently submitted by AoS, so still waiting on the responses, but I'd be interested to know that you you fighting back did eventually result in them backing down and not going to court.
