Sorry the dark word on 1st page say "claimant must by no later than 31st of July 2006 pay the court the required hearing fee of 27 pounds or submit fully completed applications for help with fees. If the claimant fails to pay the fee or submit a help with fees application by that time the claim will be struck without further order.,"

So it's been allocated to small claims for hearing on 21st Aug which you will need to attend. VCS must pay the fee by 31st July and both sides must submit witness statement by the same date. You can start prepping yours, but hang off submitting it till the end to see if VCS do theirs first/ decide not to pay the fee.

You should at least research and think about what a Witness Statement is and how you would construct one, even if you don't commit pen to paper today. Otherwise if you find you have to submit one with no notice you'll panic and mess it up. Yes, your research may come to nothing, but I suggest it's worth a few minutes of your time now.

Bingo. Regulars will probably have seen me say this ad nauseum, but my standing advice in all cases is to proceed on the assumption your case will go 'all the way'. That way, if it does go all the way, you're prepared, and if it doesn't, you've arguably wasted some time and effort, but at least learnt something in the process.

This is easy to defend in theory.

Interesting points to note so far;

VCS are (as normal) relying on their 'reasonable assumption' argument in a situation where the driver is not identified - they pretty much lose all cases when they rely on this - what's that saying? "The definition of insanity is doing the same thing over and over again while somehow expecting is different outcome"

Only 30 mins allocated for the hearing - these are normally allocated at 60-90 mins - is the Judge expecting the Claimant to crash and burn from the outset? Seems so.

Point 9 on the order is interesting! The Witnesses from both sides are expected to attend - Will Calamity Jake finally make an appearance only to be utterly humiliated as he is forced to admit that there is no route to liability in the Claim which he has brought before the Court? Will he need a further reminder of VCS Ltd v Edward?

Yes, we can help  But you'll need to do some leg work as well.

We need to start putting your WS together.

We won't submit until the last moment - this may give us the chance to examine the Claimant's WS first.

We've got some time to do all this.

I've no idea how to do a WS or deal with any of these subjects. But again if I'm well prepared I'll go to court and do what I have to do.

Can I just ask, what specifically makes LBA not relevant land ?
