If you are prepared to take this to court, the court will view any action you don’t take to avoid court negatively. Being given an opportunity to appeal to the IAS but not taking it would be viewed badly.
Two things to consider also
1. Going to the IAS will cost the operator something like £23, it’s not just your time and effort
2. Your IAS appeal can be essentially be the county court defence that you’re going to have to write anyway
The IAS does uphold appeals, just not many of them. But that’s not the point. You have to assume that you will go to court (and we know that many claims are discontinued) and it will look bad if you didn’t appeal to the IAS.

The hearing of your appeal will take place using the Microsoft Teams video conferencing platform on: 1st June 2027 at 11:30.

The operator upheld the PCN and then the IAS dismissed the appeal as well.

I have a private PCN that I am prepared to take all the way to court if necessary.  I know the initial appeal will be rejected so I will simply present a POFA failure so as not to waste time.  But is there any point in presenting the full appeal (POFA, signage, ANPR failure and more) to the IAS?

I know it's a kangaroo court, but are there any instances of IAS upholding a strong appeal when presented with evidence?

I would rather not waste my time writing out the entirety of my appeal if there is no possibility of a decision in my favour.

Thanks

Is it helpful if I post link to all original documents?

The signs on the plan create the prohibition 52 weeks of the year and term times are not relevant.

I'm confused that this issue wasn't flagged in the cited case, instead it leapt to whose version of term times could be relied upon.

OP, you have no link with the school, so what would direct you to think that term times were relevant? Does the council publish this elsewhere?

If the TMO creates a 52-week prohibition then this is what the authority is required to enforce because a TMO is law.

I don't understand their pick-and-choose attitude, even less their frankly stupid reference to as the contravention was more than a minute after the start of the prohibition 'we are unable to cancel'.

BS.

This perfectly illustrates the money grubbing nature of modern day moving traffic enforcement.

By any measure this is a trivial contravention and there was room to move your car forward which is a basis of many a winning Appeal I have made at the tribunal.

I am rather busy with work but this one won't take long so if you would like me to handle the whole thing for you please email mrmustard@zoho.com

What happened at the two appeal stages?

You case was never updated.

Nice work.

I think we would have been interested in what the Assessor had to say regarding the 'period of parking' issue but they managed to duck that one.

Well done.

Might as well, IAS don't uphold many appeals but sometimes do on dates. Eliot v Loake is a red herring and not applicable - it's a criminal case and there was considerable evidence the keeper was the driver. In your case you can state truthfully that you were not and they have no where to go.

Don't be surprised if IAS say the charge is OK, and Smart have the right to pursue the driver!
