Theoretically you could be asked under oath in court and then you’d have to say, but few of these cases make it to court, but you should never lie, so if the truthful answer is not “No” then don’t make it.

No idea who Claude is but I think you should continue to focus on the fact that the operator has wrongly stated the requirements surrounding the period of parking.

By that way, additionally, their NtK does not satisfy the second requirement of 9(2)(b) since the notice never specified "that the parking charges have not been paid in full" - 9(2)(b) actually has two requirements but your comments only refer to the first requirement. Draw the Assessors attention to the fact that the second requirement is not met either.

Thanks, Mr Mustard has already registered the appeal now, that's exactly what he has done so I'll post updates here.
Actually I forgot to post page 1. They literally admit that we are right in both the informal and the formal representations, see the highlighted bit. Then they go off on some nonsense tangent.
I have also sent photos to show that the tape measure goes underneath the front of the car, it's not only the tyre that was within 50cm, the whole front of the car was within 50cm.
Furthermore, their assertion that my car was parked "in a manner consistent with double parking" would surely require there to be another vehicle between my car and the kerb?

For starters, stop identifying the driver. Although if you did so in your defence it’s moot.

The parking companies go from the address on your car’s V5C at the time they request it, and they are not allowed to ask for it again. Debt collectors can perform a search subsequently to discover your new address.

That idiots who have been given the mantle of quasi-judicial authority are allowed to attempt to ROB you of money is, frankly, appalling.

Of course you appeal.

In any appeal, I should preamble with something along the lines of the above(because this would be copied to the authority) so that the incompetence of those involved is exposed to as wide an internal audience as possible.

You might also use extra-procedural avenues. Not in order to get the PCN cancelled because this is a given 'While you have provided a photograph showing that the front offside wheel was within 50cm of the kerb', but to highlight the authority's systemic incompetence.

But life's short and you might just want to succeed at appeal, probably get a costs award and move on with your life.

Anyway, register an appeal - Procedural Impropriety; Contravention did not occur - post your reps and the full NOR pl.
