The Flame Pit / Re: Have I been caught?
« on: July 29, 2024, 09:18:56 am »
My post generally arrives between 8am and 3pm which would make it a pain.

My belief is the day of the offence is day 0.

How is postie going to be able to confirm the contents of an unopened envelope ?

You could accost the the postie and open in their presence for example.

Have you responded - in the manner in which you are requested to - to the SJPN.

Whilst you are corresponding with the CTO the SJ process continues. Unless you actually deal with it as required you will eventually just get convicted in your absence. You .it struggle to get the case reopened since you are aware of it.

It doesn't necessarily mean you have any actual requirement to attend a physical court.

The single justice would normally deal with it when you return the form and ask to be sentenced as fixed penalty equivalent.

You can request a hearing in front of a magistrate if you feel explaining things in person might help encourage them to follow the guidance from the sentencing council that was referred to.

Private parking tickets / Re: Double yellow line parking

It's Private land, so you are not looking for road signs. Merely the terms and conditions.

It's a bit odd that the road naming sign looks to me like an authority one. It's far from obvious it's Private land. Though the paving is a modest clue.

The sign, which they will claim was blindingly obvious and sufficient is above. Though GSV is a bit old so may not be current.

A driver parking as this one did may not even have gone that far.

-----
From the Aug 22  view it looks as though the driver was parked just before a barrier which is lowered in a GSV photograph and opposite a small no parking sign on a building wall (which is not offering any contract and is no more than a request anyway).

The woeful signage etc may become relevant later.

If you are trying not to out the driver your post 13 does just that.

It is also the case that PPL isn't a subsidiary of PPE (or vice versa). It cannot be. The director controls over 75% of the shares.

The use of "premises" rather than a business name or location is very common. (Though has clearly caused confusion).

Okay. I will post then, need to take pics of my car tomorrow afternoon.

It may be worth highlighting and describing the differences. Make it as easy as possible for them to see it is a different vehicle.

Only you have seen the photos. Is it definitely a clone rather than a misread.

It may be worth considering asking DVLA for a replacement reg.

69
Thanks both.

Essex don't appear to have an online system with the photographs so we will email them.

It doesn't stop the response timer, and they have no obligation to answer.

Unfortunately a common error. Many interpret the fact that they have previously given licence details as satisfying a subsequent requirement with a COFP.

There is guidance that is a COFP is not taken up for reasons unconnected with the the offence then sentencing should be at the fixed penalty rate.

It's mentioned frequently so a quick search should easily find the guidance and varied suggested wordings for the request on the SJPN.

Sometimes it works, sometimes it doesn't. If not at 55 in a 40 the usual penalty would be half a weeks wages, +40% victim surcharge +95 costs +3points I believe.

Don't miss deadlines. Asking questions of the force doesn't stop the clock.

If persued the permitting will typically be £300 and 6pts if dealt with via fixed penalty.

For future reference you don't need to pay on street in North Somerset with a BB and it's without time limit, but best to check the machine in the bay.

See here: https://n-somerset.gov.uk/my-services/parking-travel-roads/parking-access/blue-badges-disabled-parking-permits/how-where-use-blue-badge

Beaconsfield Road and Graham Road can be spots worth trying though a little further from Cineworld.

Private parking tickets / Re: Charge on credit card without consent
« on: July 22, 2024, 12:30:35 pm »
If the hirer wanted to use that argument (if the chargeback is declined) they would almost certainly be the one having to do the suing though!

The chargeback is unlikely to be declined. It's a voluntary process by card issuers and acquirers with limited scope for refusal, though what US rules are in place by this particular issuesr will determine whether it is allowed or not.

An issue is whether it gets re-debited somewhere down the line when (if) enterprise say "No, we maintain it was a valid charge".

With a chargeback the issuer is a go between.

Many hire companies have widened the terms to include the word "charges" to attempt to bring private tickets into scope.

There is, perhaps, a consumer rights argument. It may be an unfair term if it is not refunded where a charge is cancelled.

I have had hire agreements with:-

- Refunded if charge cancelled (fairly common)
- Explicitly not refunded
- Silent

A reasonable interpretation of the latter may be that the term only applies to valid charges.
