Probably none. But why does it matter?

I think the judge can probably ask whatever they like. I believe it has been asked.

I think your argument is simple: "They have not complied with PoFA and therefore cannot persue me in my capacity as keeper."

That may be true. But until you receive a statement of claim and skeleton argument you won't know what they are arguing. You would also need to keep the argument confined to that point.

Equally does an inability to persue you keeper prevent them from persuing you as driver ? The underlying contract was formed by the driver, whoever that may be.

Yes, of course you can state "but they don't know who the driver was", but if the judge ask the question it's a problem.

If it hasn't gone to popla/ipc, and the driver hasn't been outed then not doing a DVLA request surely means they have not complied with POFA and that might (should) get a cancellation at that point.

If it isn't and it goes to court and the question is asked unless the answer can be no that is unhelpful.

Presumably they are using keeper details which were provided by the OP in the original challenge of the windscreen ticket.

Also what is the evidence of payment and it was, until the story is provided, "the driver" who did things.

Ultimately with a popla rejection it is a waiting game to see if they sue in the next 6 years

You can contest anything you want.

Doesn't mean you will win.

Millions of private tickets are issued annually. Most (rightly or wrongly) are paid.

Many thousands of people are routinely sued. Some companies are more aggressive than others.

If your friend puts it into practice sooner or later it will end badly.

They will have got your details from DVLA. But that works on date.

You can't necessarily achieve the time from DVLA but you still have a timed photograph. The more the better.

You have a call log for example.

Plus a timed example of the bank transfer.

Paint a picture (again).

If you go to tribunal the full penalty will be at stake.

An oral hearing is recommended rather than a written one. That is inconvenient of course.

You evidence looks solid to me. I would also add screenshots of the message exchange, hopefully they are timed and show you had arranged to meet after the time of the contravention.

I would also try and get a date and time of the owner change from DVLA. I would do this both via the online contact (they then reply by email) and also a subject access request.

I appreciate you can make it go away for £35, but I personally would rather end up paying the full penalty than that.

I would include failure to consider. It is obcious they haven't. You supplied most of what they are asking for.

They gave you an "out" to provide that information (again) did you try it?

It would show how reasonable you are and unreasonable they are if again rejected.

Do not let any dealines expire for tribunal, otherwuse you lose by default.

Read the description of the contravention. The dropped kerb is the issue.

If you download and publish the photos (if any) which would normally be on the authorities website that should show whether you were overhanging the dropped bit and also show ehether it is dropped for one of the relevant reasons.

On the likely erroneous assumption that it's not just some form of inverse marketing the probability is you will get just as good - or usially better - advice here and free.

Though you will have to put in a bit of work.

A number of incarnations of the sorts of operations have previous left people in a bit of a mess.

What has changed in the last 6 weeks ?

Can you recall when the signs went up ?

It seems very odd that since pcm allegedly started enforcement over 5 years ago nothing happened until 6 weeks ago.

Have you changed your vehicle ?

Are the carers new and thus new vehicles ? (though I imagine you have many different carers and not a consistent predictable set).

In terms of the tickets on the carers vehicle you can't appeal them. You have no standing (though the carers could authorise you to. However PCM will happily take your money).

You need to discover the permitting/white listing arrangements.

PCM will expect you to display and your carers to display a visitors permit. Otherwise it seems likely they will keep on coming.

Whether or not PCM have a right to this either for yourself or visitors is a different thing, but if they don't see it they will continue.

As a reminder when you are being driven anywhere your BB has no particular meaning on private land.
