Ok, I haven't got adblock on atm and it didn't let me scroll down. I first read your post thinking you were done for going past the 7.5t sign, which as a professional driver myself, astounded me that you even came to complain. My mistake.

Post the back and hopefully the council have got something wrong in the writing of the PCN. Google street view isn't really helpful, it jumps between 2020 and 2022.

Regarding your point of a why not have a no entry sign, that is a no entry sign. A circle sign with a red border is sign that prohibits something. In this case, it's anything with a 7.5 mgw or over. Considering you have been fined for failing to comply, you're a professional driver with at least a C1. Why would you even follow waze blindly - it's made for cars.

They do seem to be suggesting that the notice is issued and served on the same date. Seeing as it's a postal PCN, they should allow for 2 days of service.

That is the only thing I can see and it would be for someone more expirenced than me to assit you in arguing that, if I'm right

Looking back the the posts im getting that info from, what I’m referring to is a rejection of representations - It seems like it’s all legit, unless someone can see something I’m not

A third and final POPLA has come through where they identify me as the driver, which is funny because their own evidence shows that I appealed as RK and never identified myself as the driver.

Rebutted as per the last 2 and additionally rebutted their claim of me as driver pointing out their own evidence shows that I am RK.

Also noted that due to their failure to prove how I have been IDd as the driver the second Ntk is not POFA compliant.

Thank you , sorry I had read READ FIRST , but was panicking  I haven't had to negotiate this before , I have responded to the s172 I was wondering the consequences of being a New driver as I have had my license for under 2 years and if penalties are harsher as I have had my licence for a shorter period

You’re all good mate. I got done for 56 in a 40 having only had my licence about 6 months and only got 3 points because I got caught at 80 on the M25 a month previous and took the speed awareness.

Take a chill pill, you’ll get offered a speed awareness and still have a clean licence.

Lets not appeal just yet and absolutely do not admit to being the driver - should what I'm about to suggest not work, Parkingeye not knowing the driver will mean you don't pay them a penny.

By far the most hasle free route to getting this cancelled is calling the store and asking for a manager. Explain the circumstance, the PCN in itself proves you were there for about the right amount of time to change drivers. Hopefully they will understand. If they do agree to cancel it, ask for an email address so it can be put in writing as proof in case you need it.

This stuff boils my blood. Why dent a working mans wages. The amount of these I've had in my work van, liveried up with the supermarket I work for, is silly.

Can you provide what exactl you say in the appeal to the council initially?

As the double yellows closest to you warehouse outright ban loading at anytime, this loading bay is the closest reasonable place to load. If what you meant by "packing" is putting things from the warehouse onto a trolley, then that is loading and you may have a chance at the tribunal.

Let us know if you've paid it and maybe we can look at submitting somthing to tribunal.

This is very strange. The images don't show the exit to the box and barely show the enterance. The quality of the images are shocking. You are allowed to enter a box if your exit is clear - you can't see that. There's no context, it just shows your car. #

Bumping this so @MrChips who's been active in the last hour and is the Yellow Box knowldge man can maybe asist. I'd personally appeal on the basis the images they've provided do not allow you to form an appeal and that they should wait until you have got the CCTV of the alleged contravention - which will come on a DVD disk, btw - to allow you to put your case forward

I think you're stuck on this one as its two yellow boxes. The first yellow box the only exits are turning left and forward, you did the latter. It's the second yellow box you would have been ok to enter as thats the one you are turning right in.

I do notice they haven't provided video of you stopping but I'm sure being in possesion of this would help your case - unless you hadn't stopped and were moving slowly.

A fair amount of time has passed so, I'm sure you might want to keep that lower fine of £80 rather than try and go on a wild goose chase that has no chance.

So, I had a little trip up that way earlier. There is an advanced warning sign of the no right turn. The arguments I can see are that there is far more important signage for drivers to pay attention to, like the traffic lights for the pedestrian crossing just before entry into that road.

Even with a decent phone camera, it struggles to read the sign details from closer to the bus stop you see in the dash cam footage than the sign. You'd need someone smarter than me to argue that though. I will simply post my images and dashcam and watch from afar going forward.

Do you have a dashcam on your vehicle? Might be worth trying to argue it with that. It appears you can't actually see it until you're committed to the manoeuvere, if at all.

If not, I'm local and can't stand ealing council and their money grabbing. I'd be more than happy to drive the exact same route and supply my dashcam footage to assist with the unclear signage point.

Ealing council will refuse the appeal, so you really need to be ready to take this a lot further.

No. Its a width restriction - It's purpose is to stop vehicles that are above the specified width passing. That's why theres a red circle - It's a prohabition sign.

Even if the van is 2345mm wide, its above the 2000mm restriction. I'm not sure what your brother was thinking passing this sign.

Pay the lower fine, if you've been offered one. If caught by the police, it'd be 3 points.

Just point out to the assessor any points from your appeal that they have not rebutted and rebut any new points they may have raised in the "evidence'!

Absolutely. It boils my blood that they include a close up photo of the entrance sign the speak is hinged on. Completely out of context and borderline fraudulent!

Anyway, my reply was this;

Second POPLA operator docs came through today - Same boilerplate response with no direct rebuttal of any of my point and evidence.

I’m kind of using this forum as a secondary way to document times and dates of what happens when - I do apologise about any unnecessary notifications anyone gets.

Of course they have a standard evidence pack, it would be expensive to craft a unique response to each case. The duplicate letters seems odd unless they are reminder letters, if they have the same reference it's only one PCN, don't over think it, their systems will be automated so it's unlikely to be human error.

As for the email, you sent a query via their privacy form and received a reply confirming it will be dealt with by their privacy team, not really that odd.

I do find it odd.

It’s not a reminder for a PCN. It says Parking Charge Notice and on the back says I’ve been IDd as the driver - which I have not done.

It has the same PCN number as another PCN issued a few months prior but is issued on a different date and they’ve reissued a second rejection letter with the same POPLA code
