Very strange that a course wasn't offered either for one of the offences ...

You can attempt to prove the late delivery, your statement (or that of your Son as well as your statement) is evidence to the late delivery, but probably not sufficient ... however if you can get your Post(wo)man to testify as to what date(s) they delivered post to you then you are starting to swing the burden of proof your way?

Tell us more about the potential late NIP? How do you know the date it was received?  What is the date of the NIP?

Contact the council or highways authority responsible and ask for the TRO that implements the temporary speed limit.

You would need to have been exceeding a single limit for the entire period of time - ie 61 all the way and 50 limit all the way ... which is not likely?

Who is the registered keeper of the car? If the RK is deceased then write the clampers/DVLA informing them of the fact. Not your problem to pay any fines for someone else.
It is however the Estate of the deceased's problem?

Are you sure you want to plead not guilty?

I think your defence to the S172 charge is weak, and it would take a fair wind for you to be found not guilty.  You were not really equivocal in your response and did not nominate anyone else which is your responsibility as the RK (although not apparently the keeper at the time).

A contested trial is going to cost you around double in terms of costs and a larger fine etc.

Your daughter was effectively the keeper.  You should have nominated her.

I hope you are not suggesting you've been 'fronting' = your account looks dangerously like that might be what has been occurring.  You don't seem to have any reason for being the registered keeper at all?

Your email response is potentially your get out here - you cannot be found guilty of the speeding offence as no driver nomination was made (apparently); so it falls to the Failure to Provide charge, and what you wrote in the email is going to be of key importance and whether you can prove it was delivered (the same applies to your written response, but it appears that was not received).

It really is not a tricky situation at all.

The RK nominates you as Keeper, and you in turn nominate the Mechanic to whom you dropped te vehicle off to.

How to turn something simple into a S172 offence and the resultant 6 points and large fine and a massive hike in any insurance policy due to the MS90 conviction code.

Have you received a SJPN notice yet?

If so and if you have been dual charged with both the speeding and FtP offence the procedure recommended is to return a Not Guilty plea to both offences, and then you can 'do the deal' with the prosecutor to drop the FtP charge in return for a Guilty plea to the underlying speeding offence ... there is more detail to help you available on this forum, which you can search for.

However, the fact that nobody here - apart from me - has suggested you use them makes me wonder if that is a referral that this site would still make.  I simply don't know...

I did think of it, but not sure they are going to be much help here - the baliff will be executing a valid warrant and the only way of fixing that as discussed here is via the Court.

Reason will never come into a Balliff's process - they have a job to do and get paid when they get the funds.

Best to make sure anything of value is not available to them for the time being.

Sandy - am I the only one to think you may not be the 'he' they are all referring to?

I think you think this will be made to 'go away' without it being referred to the Court.  At this stage it's quite clear that it will be and therefore I'd be requesting a hearing rather than a SJP procedure.

Does the NIP include a requirement to identify the driver (S172 of RTA)?

If so you must reply to this as to not do so will be a separate offence.

You need to respond to the S172 request with the details (and supporting evidence you have mentioned) of your trip away and details of where the keys were and who had access to the keys / the vehicle whilst you were away.

You presumably had a conditional offer .. or did you?

There is a lot of detail missing, please update the forum for maximum potential assistance.
