The Flame Pit / Camera van antics
« on: October 31, 2024, 01:48:03 pm »
A motorcyclist (Moto) rides into a layby and stops then realises he is facing the back end of an unmarked speed camera van. After a few moments the camera van operator gets out and walks up to the rear of the motorcycle and takes a photograph.

Several days later Moto gets a 38/30 speeding ticket for the layby location and realises that he was clocked by the camera van.  When he left the layby the camera van had already departed so it appears the photo taken of his number plate was used to identify the motorbike.

The offer of a course was accepted and attended during which Moto made comments and queried the qualifications of course operators at which point he was asked to leave.  Subsequently, he was offered another course for £35 or the penalty plus points.

Any comments?

Speeding and other criminal offences / Re: 71 on a 70 road...
« on: October 31, 2024, 12:50:55 pm »
Hi folks - thanks for what you do  :)

I got a letter from the police saying I was doing 71 on a dual carriageway - and replied to declare that yes, I was driving.

Then got a 'Conditional offer of fixed penalty' letter saying that it's going to be a £100 fine and 3 points.

This confused me, because I was only 1mph over the limit.

so I emailed them, saying basically the same as above "is there a mistake - this seems unreasonable"

Since then, I did some research - yes the road is a 70, but they've classified my vehicle as a 'goods vehicle' - which means it's actually a 60 limit.

It's a 5 seater Mercedes Vito - which we use as a family car, no 'goods' ever transported, never used for work etc.
The V5 calls it a 'light goods' vehicle.

Thanks

You need to identify EXACTLY which Vito model it is.

On your V5C what is entered at K -  Vehicle category - M1 or N1?

If it's M1 then it is incorrectly entered as Light Goods vehicle at  Taxation class by whoever filled in the form.  It should be car or MPV.  Dealers are known for making errors with this type of vehicle.

If it is N1 it's a commercial vehicle perhaps a crew cab version?

Plenty of information on the web by searching Vito sped limit etc.

Phew, a close on this afternoon, "the driver" parked my car on DYL in Folkestone while I popped into the chip shop about 50 yards away to place a quick order. I have a blue badge and that was clearly displayed. But then noticed the blips on the kerb! The chip shop was quickly done and went back to the car as quick as I could move which is not at the moment very easy due to a trapped nerve in my leg!

About 2 car lengths away I saw the ominous figure of the local Civil Enforcement Officer doing a quick march down the street towards my car. I shouted out to him and he stopped in his tracks. He said something like "you got a blue badge, you should know the rules, I should give you this ticket". He didn't so I got in the car and made a hasty retreat. He wandered off up the street and booked someone else. He certainly couldn't have made a 2 minute observation. Let's wait and see.

Observation period on DYLs?

While we're on the subject of pedantry, let's then ask:

1. Does it count when you start to cross the line (like in rugby) or when you've fully crossed the line (like in football)? (I know the answer comes back to de minimis, but what the heck).
2. Why do you have a towball on the front of your car?

It's very useful in pushing a caravan into a restricted space.  All seasoned caravanners (should) have one fitted

Likely variable, look here for at least one set of cameras between M1 28-29 Northbound: https://www.google.co.uk/maps/place/4M69%2BQ3F,+Alfreton complete with the variable signs.

What are "national speed cameras"? Are you getting confused with "average" speed cameras used mainly in roadworks on mways?

According to PGPSW there is a 50 mph limit and a mixture of specs (average speed cameras) and Gatso fixed cameras on M1 between 28 and 30.

The Flame Pit / Re: Swiss Speeding Ticket
« on: October 02, 2024, 01:37:11 pm »
The Swiss authorities have my details hence the ticket, these were passed on by the car hire company that charged me a £35 admin fee for the privilege, the fine is €120, the ticket says they will pass on to their crime unit if not paid within 30 days, but I'm assuming and hoping they won't take any enforcement action, although I expect a letter seeking to let me believe they will

That sums it up well. The €120 penalty indicates 6 to 10 km/h over an urban limit so relatively minor by Swiss standards. Hire cars and speeding do not mix well in Switzerland.

Of course, if you were speeding you could pay up before the next request for a much larger amount!

Yes, I'm aware of that, but it's not unknown for the Swiss to control their borders, frequently!

I don't know what arrangements the Swiss may have with the EU for cross-border exchanges of driver details for motoring offences.

As stated above, so far, only Germany has across border agreement with Switzerland for motoring offences.

Spain has a cross border agreement with the UK.**

Presumably your reference to border controls is in relation to ETIAS and EES about to the right of entry to and exit from the EU.

Checks relating to motoring offences are not included but could be possible in the event of a subsequent traffic stop within a country. France and Germany keep ghost licence details of offending vehicles and there are reports of cars being stopped in Hungary for offences committed on previous visits.

Edit:  ** Spain can obtain keeper details but not enforce in the UK.

A long shot I've had a speeding ticket come through the post for an alleged offence whilst on holiday in Zurich, anyone one know if the Swiss authorities will take steps to enforce
[/quote/]

It cannot be enforced in the UK.  It will be recorded and it's very likely the vehicle will be stopped if it returns to Switzerland.

Switzerland is not in the EU but has just concluded an agreement with Germany regarding motoring offences.

The Flame Pit / Re: towing a car
« on: September 09, 2024, 10:03:40 pm »
If it were towed with an A-frame (with linked brakes) then according to dot Gov the A-frame and vehicle combination is treated in legislation as a trailer. A trailer doesn't require MOT or tax, but has to be roadworthy.

https://www.gov.uk/government/publications/a-frames-and-dollies/a-frames-and-dollies

I suspect it would be easier to put it on a trailer than fit an A-frame though.

(And if it were any distance, something would need to be done to prevent gearbox damage, like removing the prop shaft.)

An A frame is for recovering a broken down vehicle to a place of storage or repair.  Once there the vehicle cannot be moved again on an A frame. A frames are not trailers as they cannot meet the Construction & Use Regs that apply to trailers.

The legislation is widely abused with few prosecutions and those usually occur within a few miles of car auctions selling accident damaged vehicles.

Recovering vehicles  by A frame on motorways requires the unit to leave at the first exit.

Speeding and other criminal offences / Re: NOIP : 71mph in 70mph area
« on: September 02, 2024, 11:27:35 am »
Hi All,

Was driving on A5 in Milton Keynes (Bletchley) in my Citroen e-berlingo, passenger version, 23 year.
It's 70mph area there, no road works.

I suspect they misidentified my car as a van which would have 60mph limit.

On its V5C my car has:
D.5 body type : MPV
Taxation class : Electric
J: Vehicle category : M1

They also didn't provide any specific location on the NOIP, just "A5 (Bletchley)" which is a bit too loose definition.

It's quite specific in that it's dual carriageway in both directions for 4 km in Bletchley.  There are two overbridges which are the usual sites for manned speed cameras.

BTW your written English is excellent and much better that some native speakers.

Some might suggest that it indicates the mindset of those who have such plates?

But it's certainly not dangerous to the Feds

Many thanks, out of curiosity what can be a good defence? Faulty speed camera/medical emergency?

I suppose even then if would require going to court, so just not worth it, even if that.

Also, is there any grace allowed over 20mph?
There are lots of possible good defences, but as we don’t make thinks up you can tell us of the scenario.
Technical defences would be a defective Traffic Regulation Order (that sets the limit) or signage (that tells you of that limit).
Most speed cameras are very accurate, I’m not sure what type is fitted on VE.

Yes,as in all limits grace is +10%+2mph so 24 in a 20, you were caught at the lowest detected speed they enforce.

??

Grace is 10% + 1 and enforcement from 10% + 2?

Private parking tickets / Re: PCN liability in driving lesson
« on: June 28, 2024, 04:04:32 pm »
The Hirer, your instructor, should have known better than to teach you on private land, at least not before seeking out any terms and conditions for using the land beforehand.
I am surprised that any driving instructor would use a private car park for their lessons these days. Almost all are covered by such Ts&Cs, many with ANPR, making it a risky action.

Of the several supermarket car parks that I use I have often seen driving school cars practising.  Every one of these car parks has T&Cs displayed. However, few lessons would exceed the usual limit of 1½ or 2 hours.

I wonder if the op's instructor uses the same car regularly and, if so, do the charges relate to the op or some other students?

It's confusing signage approaching that bridge in the permitted direction!
