The Flame Pit / Re: Speeding Offence : Send a foreign driving licence ?
« on: January 10, 2025, 09:32:49 am »
The reason you could not obtain a new Greek licence unless you handed over your GB one is that, for driving licence purposes, nothing has changed since Brexit. You can only hold one licence if it is issued by any of the 28 nations (27 EU plus GB). For the same reason you would no have been granted a GB licence if you said you held a Greek one.

It's got nothing to do with the OP but in fact for driving licence purposes everything has changed since Brexit.

There never was any necessity to exchange a UK licence for an EU licence as a UK licence was of course a perfectly valid EU driving licence. Neither the Withdrawal Agreement nor the Trade and Cooperation Agreement make any mention of driving licences. The previous automatic exchange of a UK licence for an EU licence or vice versa is now no longer possible.

I personally know the situation in France where if a Brit now takes up residence then provided their UK driving licence was issued before 31st January 2020 they do not need to exchange it for a French licence until it expires. However if they passed their test after 31st January 2020 then you only have 12 months after they become resident to exchange their UK licence for a French licence. If they miss that window then they cannot exchange & must pass a French driving test to legally drive in which case they will quite legally hold both a valid UK & a French driving licence.

Every EU state now has different rules for licence exchange as all post-Brexit arrangements for driving licences have had to be agreed on a bilateral basis.

The Flame Pit / Re: Stormzy totting ban

The news report I heard said it was a totting ban as he already had six points on his licence for previous speeding offences.

Both APCOA and SABA are BPA members and offer a secondary "independent" appeals service through POPLA should the initial appeal to the operator be rejected. However, I do not believe that POPLA have the authority to adjudicate on PNs which are (if they were real ones) criminal matters. As these fake PNs are nothing more than "offered contracts" (under civil law), there is no obligation on anyone to accept an offered contract under any circumstances.

POPLA refuse to adjudicate on PCNs issue under Railway Bylaws.

But the principle is the same, whoever operates the first ("give us £100...") part.

If the TOCs undertake both parts they are no different to the police who might firstly offer a course or fixed penalty and then prosecute when they are not taken up.

Quote
In other words, they are asking for a bribe in order not to criminally prosecute them.

That's certainly one way of putting it.

I know virtually nothing about decriminalised processes and procedures so cannot comment on the deficiencies you mention. But the important thing with these railway offences is that they are not decriminalised. They are not subject to review or adjudication. If he motorist does not pay the bribe, the only way the TOC can get paid is to prosecute him through the magistrates' court.

So the rules and protocols pertinent to the decriminalised offences do not apply.

If the motorist is fined in the magistrates court the fine goes into government coffers. The TOC will receive no money whether the motorist is found guilty or not guilty.

The Flame Pit / Re: Provisional licence and Pass certificate
« on: December 17, 2024, 07:13:08 am »
It must be an unusual situation to have to apply for a full licence, In the past couple of years I have spent many hours in the passenger seat accompanying two learner drivers. When they subsequently passed the driving test the DVLA automatically sent them their full licences which arrived within 7-10 days of the test.
It's not automatic. The examiner asks whether you want that, and if so you must give him your provisional.

Ah! I hadn't realised the actual procedure & have just had my wife confirm that she had the option of keeping her provisional licence. I imagine that the vast majority must opt to have their full licence posted on to them.

Never mind whether he was fiddling with the phone or not it would have been obvious to anyone viewing an image or video that he was listening on headphones. How could he be so stupid as to think that it would OK?

The Flame Pit / Re: Car Damaged While in the Care of Garage

I may be cynical but my immediate assumption was that there was no 3rd-party involved & that the garage damaged the car themselves.

My primary concern is about a criminal record, my employer will certainly raise it, if it shows up on an enhanced DBS check.
If it doesn't show up do I still have to declare it?

I have never had a speeding conviction show up on an enhanced DBS check, nor on a BPSS. I also never declared them but some people I have worked with have, usually to be told it isn't a concern. It is a question of whether it's seen as 'withholding information'. Personally I asked first and got told not to bother unless it was an imprisonable offence.
Do you really mean speeding conviction? I can understand accepting a speed awareness course after an FPN does show up but not a conviction for speeding in the magistrates court. I know from personal experience that a conviction for driving without due care & attention does show up on an enhance DBS check

Is Bulgaria in the EU/EEA? I've lost track... The driver of the other Bulgarian van who spoke good english dealt with my partner, he was following the errant driver. The paperwork he gave my partner was all in Bugarian script!

Yes.

The Flame Pit / Re: This sites Facebook Page....Some observations!!
« on: August 05, 2024, 06:06:35 pm »

I can only assume London is a nightmare to drive in and is becoming even worse??

Never has a truer statement been made!

- Box junctions becoming standard everywhere and enforced by cameras and postal PCNs
- Bus-only turns that are only in force at certain times, but on roads that are so busy it is quite impractical to read and understand the sign without inconveniencing traffic behind you, who being Londoners will of course start honking horns after 0.01 of a second
- ULEZ (won't go into this!)
- Hardly anywhere to park even in the suburbs, the few remaining places rapidly all becoming residents permit areas
- The above meaning that the few places available to park in are heavily contested, with local residents keying cars that park there or slashing their tyres.  3 times within a year for me, and this is in an otherwise very sleepy and crime-free area
- Any private residential areas now enforced by rabid PPCs and their despicable debt-collector sidekicks
- I could go on!

You forgot to mention the absolutely appalling standard of driving from the majority of drivers.😀

It only had a couple of weeks to run anyway so wasnt going to reach 100,000 in any case. The Government gave it's initial response in late May, saying pretty much what should have been expected.

In context the petition supporters equate to around 0.09% of the adult population.

or 0.0675% of those holding a driving licence.

13
Surely the evidence from the CEO confirms that the car had moved? They have noted front as 11 on first observation then 12 on second observation.

You would need to pass your driving test in both the UK & EU state to have two driving licences. Do you actually have two driving licences or is this just a hypothetical question?

DD limits were a lot higher in those days1 Not that I was driving then, I was too young.

As far as I recall blood tests for alcohol were introduced at the same time as the breathalyser so if you failed the breathalyser you got a blood test. The blood alcohol limit for drivers has always been 80mg/100mL. Previously they would have tested drunk drivers by getting them to walk a straight line or recite "The Leith police dismisseth us".
