So she has typed out a representation which I have just copied and pasted below. Looks to me that it might want a bit of a tidy up. What do you think?

When parking 25/01/24 I looked at the previous days scratch card which was dated 24/01/24 and so as I’m a retard I started to scratch off 24th on the new scratch card when I noticed on my watch it said 25th.
Because of the limited number of scratch cards available I didn’t want to waste one and therefore scratched off 25th.
None of your evidence shows the scratch card had been used 24th- it wouldn’t as this was a mistake of mine.

I would like to add that I have tried on numerous occasions to get an A2 parking permit. As a Shop owner in Scarborough I am entitled to a permit however the council still, after 6 months, haven’t issued me with a rates bill to allow me to pay for the permit hence why I didn’t want to waste a scratch card.

Based on the information above I am appealing on your good will to overturn this ticket.

Yes, the V5C is up to date. She says she will make a plea on the grounds she's a bit of an idiot (not quite the word she used)  ;D

So, I've just driven down that road and if you turn around on street view there is two more 'Disc Zone' signs before you get to the left turning and another one before the next left turning. So another 3 signs within a 20-30 second walk.

As with the permit, she has said she didn't want to waste one so chanced that one would still be ok.

Yeah, that silver car is hers and she is the registered keeper. Do you want me to pop there today, see if there are any other signs nearby?

The 24th being scratched was kind of deliberate. I asked her about that and she said she just wasn't thinking, she just saw 24 on the previous days card and just started scratching it off before noticing 25 on her watch.

I've noticed on a lot of threads on here the wording on the PCN is very often wrong. That's not the case here then?

Hi everyone. The girlfriend parked with a residents scratch card on the dashboard scratching off the correct date (25th) and with the 24th also partly scratched. The contravention given is 'Parked in a disc parking place without clearly displaying a valid disc' and it is Code 35.

The letter above and the two that have been deleted are the only letters she has received. Initial Parking appear to be the ones that manage the car park but we haven’t received anything from them, only the three from Debt Recovery Plus. We’ve typed the details into the Initial Parking website and nothing came up about this charge whatsoever.

I’m currently at work and on my phone so I can’t redo them letters that were deleted until this afternoon, Imgur works differently on my phone compared to the laptop and doesn’t allow me to do anything with images.

Please accept my apologies guys, after New Years Eve, yesterday was a complete write off, I was dying and didn't even get out of bed. Even the cats walked in the bedroom, looked at me and then walked out again in disgust. And I've been at work since 6am this morning.

So, first of all I can't see where to delete them photo's I posted. I did do them via Imgur and then copied and pasted the link onto the post.

And secondly she's received another letter off Debt Recovery Plus today which I will attach below.

These three letters are all she's had. Should there have been one from Initial Parking to start with?

Appear have parked in a private carpark on what appears to be the 23rd October (going by the Parking Charge Date on the Debt Recovery Plus letter). She thinks she was there for less than 30 minutes.

The first letter she received from Debt Recovery Plus is dated 27th November. She messaged them on their online portal on the 4th December and has received no reply. She then got a second letter from them dated 18th December. She then called them on the 20th December and was on hold for 29 minutes before giving up. She called again on 27th December and after 11 minutes it said she could leave her details in order to save her place in the queue and they will call her back. They didn’t and still haven’t called her back. 

Now, am I right in thinking £170 seems excessive to be charged and isn’t there supposed to be a cheaper option if paid in a certain amount of time?

I’ve attached the 1st letter front and back, 2nd letter front and back and the pre-legal action letter that came with the second letter front and back. The back of that one is blank. I’ve also attached the GSV link for the car park.

Any help on this would be appreciated.

So I replied to North Yorkshire Councils rejection of my PCN appeal with the following:

Thank you for your response to my PCN challenge. I would like you to send me a Notice to Owner as I will be making formal representations. Could you please send me the relevant Parking Order that you refer to and based your decision on not to cancel the PCN as the only one I can find is from 2012 that relates to the old coach park and does not cover the disabled bays.

Thank you for your time

In just a few hours I received the following reply from them cancelling the PCN.



Essentially what they have said is 'Dear Mr Fowler, as you appear to know what you’re talking about we have decided not to gaslight you on this occasion'

Well thanks for the help. I really thought the fact there are no signs would have made it a slam dunk.

I took photo's of the whole car park to show there are no signs and also the entrance to the car park of which yet again no sign. Hopefully you should find all the photo's I took below.

I was thinking maybe more about the car park order and the fact that the disabled bays are outside of the footprint of the car park as it is shown, and also how the car park has fundamentally changed since the order was made.
