Sounds like it's been on a public road for a long time.
Not necessarily - more likely been SORN for a while.

The back calculation is a multiple (2x for the OCS) of the unpaid tax to the point it was SORN'd.

GSV is October 2024 - obviously may have changed… A site visit mandatory to even consider challenging.

Possibly but remember no 'warning' is required (Other than the speed limit signs).


...but as noted we can't say anything more without knowing location and possibly seeing the snap.  (We're rather good at reverse engineering)

You need to expand on this... At the point of accepting the CoFP they would request full details and you say you supplied just the last 2 digits?

i have misplaced the logbook however I received a NIP in February last year to my home address (mrs was driving) so i know that the records are correct.
Well, that may show the V5 was correct in February...                                             

I have had issues with post not being delivered and have proof of a missing delivery from the royal mail in September last year.
As NJ points out the onus is on you to show they didn't arrive.  Any such evidence from the RM may assist in this task.

I was also not the driver at the time of the offence.
Then you plead not guilty to the speeding.  (The s172 offences are the concern as they carry 6 points each if convicted)

Both offences are generally 'dual-listed' to give you the opportunity to offer to plead guilty to the speeding if they drop the more serious charges.  (But you can only do that if you were driving)

The vehicle is registered in my name and at my current address.
How about in November when the Police queried the DVLA?

Dig out the V5 and double-check the address is 100% correct.  Also, check the DOCREF date (At the bottom of page 2 in DD MM YY format) that records when the DVLA last updated that V5.

A ton isn't necessarily an 'instant ban'.

Indeed, the SJPN process will consider 6 points first before referring the matter to a hearing - you may get lucky.  (It is just a band B offence)

Any ban would be relatively short, a matter of a few weeks unless there are any aggravating factors.

No.

It's going to court.  They have 6 months to commence the prosecution and they often leave it to the last moment (just when you thought they had forgotten).  However, you'll be able to plead guilty by post and hopefully they won't require your presence to consider a ban.

It will be 4-6 points (likely 5) and a fine of one week relevant earnings plus costs and surcharge (40% of the fine).

Probably - but you're not at that stage?

...but the certificate refers to the system as a whole and you have a reference to a component in that system (in this instance a particular sensor - probably displayed on the exit  photo they have)

As you note in your previous post - it would have been logical to ensure the two references align.  (But it's not a defence, especially due to other reasons hinted at above)

The post-processing of the snaps may have resulted in incorrect car being identified.

1) The location being between the Merrion Avenue and Pangbourne Drive should be slightly more specific as there is another junction in between with Dovercourt Gardens.
Yes, there is a junction along that road with Dovercourt Gardens but there is no requirement to reference it.  The start and end point are roughly 700m apart - the location is merely directory and that is not vague enough to prevent the driver recalling whether they were there (or not).  It would take just over 1 minute (or perhaps less depending on how much over the limit) to traverse it...

2) There is no junction of Merrion Avenue on Dalkeith Grove as that junction, Dalkeith Grove actually become Du cros Drive, so the address is technically incorrect.
It does appear Dalkeith Grove ends roughly 60m before the junction with Merrion Avenue (Indeed becoming Du Cros Drive) but see the answer above.  Arguing the driver was disadvantaged by such a small technicality is optimistic.

Are the above issues above enough to get the ticket quashed?

The timestamp difference is unlikely to be relevant unless it's wildly different.  (Without knowing the specific device it may not be GPS synchronised anyway - 'proving' you were stationary at the 'exact' time isn't going to cut it)

It appears to be a corroborated measurement by a laser device without video evidence.  (That, in itself, is not fatal)

A virtually instantaneous laser measurement versus telemetric system with low accuracy and averaged measurements.  You would likely need an expert witness from the system's makers - they may well decline and may state the system is not designed for such use anyway.

It seems a was a frontal ping, so not sure of the relevance of items being towed?

A 'slip error' requires a smooth movement of the device across a flat surface to fool the device into reporting a higher than actual value - a 'complex reflective profile' (if even scanned) would most likely trigger the reading to be abandoned.  The officer's statement will obviously be a factor.

Either you have been prosecuted without your knowledge or you haven't.

Given they have to commence the prosecution within 6 months of the offence* there's no additional risk in contacting them.  If they had 'forgot' to prosecute then it's too late anyway for them to start…


* there's potentially two offences in play.  (Any s172 allegation (driver nomination) would be roughly 1 month after any request - but also seems past the cutoff to prosecute)
