No you are misinterpreting what I just said.
I attended court (though never in person)
Well that clears that up...

I did say I went to court on my first post.

... All of them. I have no idea why I was not disqualified. I never got a letter for them. I only found out I had a fine after chasing 2 months later...

Sorry but are you saying that you never attended court in January, that the court never contacted you to say what the outcome of the trial was, and that you only learned that you had been fined £80(?) when you chased it up with the court yourself?

As others have said you might be better to find a lawyer who can get to the bottom of this and unravel what isn't relevant from what is

No you are misinterpreting what I just said.
I attended court (though never in person), I was tried, and as I said before I got a letter saying I was going to get my licence suspended and if I had something to defend against this, and that's when I replied with the answer I said.
After that I did not get any more replies and 2 months later I found out I had £80 fine and 3 points on my licence.

In the start of this post I posted my previous post with everything you need to know about my earlier issues.

I would beg to differ.

In your earlier post you mentioned seven allegations. You said you’d paid a fixed penalty for one and were thinking about doing the same for another (but we don’t know whether you did). We’ve no idea what happened with the remaining five.

I already told, first one I paid the fine and for the remaining I got an £80 fine (already paid)

Also according to your post, all the NIPs arrived after the 14-day period required by law (between 40 and 58 days after the alleged offences). You were advised what this means in terms of a possible defence.

The last we heard was that on January 11th you told us you had received a letter telling you to expect a date for a court hearing. And that’s that.

I could never prove that I had change the address on the V5, so this was never a defence.
I was considered guilty and asked to give an explanation of why I should not have my licence suspended, as I already mentioned my reply.

Now you tell us that you have another allegation made against you and all you can tell us about your earlier court appearance is that you were not banned. You gave two explanations for this, one of which (the court removing the earliest of the nine points you said you had) is plainly incorrect and the other (them allowing you to continue to drive because you said “something about needing a licence for work") is extremely unlikely.

So we need to know (as a minimum for starters):

What offences you either accepted fixed penalties for, or were convicted in court of, the offence dates and the number of points imposed. You can find this out by checking your driving record online:

https://www.gov.uk/view-driving-licence

I already told you only one offence appears as current on my points.

How many of those offences were dealt with at your earlier court appearance and why, with seven allegations that you mentioned, you were not disqualified.

All of them. I have no idea why I was not disqualified. I never got a letter for them. I only found out I had a fine after chasing 2 months later.

That’s the only way you will begin to get any sensible advice on here.

You asked whether it was worth employing a lawyer. My answer is that if you are similarly reticent or unable to share important information with them as you are here, you are wasting your time and money.

I gave you all information I have. there is nothing else to disclose.

...is it worth or not to get a lawyer?
I think you may need one to unravel what's actually happened as it may be critical.  (For example, let's just say you did have an EH accepted then you cannot run that argument again)

But Lawyers (Barristers) cannot magic defences if there isn't one.  As an example, see This recent thread.  The barrister gets paid (handsomely) no matter what the outcome for you...

Thanks

I can't remember exactly what I said, something about needing the licence for work and that I was just distracted by it.

That would not have succeeded as an "exceptional hardship" argument.

As I mentioned I cant remember exactly what I said. Just that I got to that stage and later I only got a fine for £80

In January I was in court and they just removed my oldest offence that had 3 points and put this last one.

Courts do not do that. The points automatically become inactive for "totting up" purposes three years after the date of the offence.

You've got o help us a bit here if you want meaningful advice. Just providing small snippets of what happened (some of which are clearly wrong) doesn't help.

As a start, what were the dates of the offences which led to your previous points and of the one which led to your last court appearance?

In the start of this post I posted my previous post with everything you need to know about my earlier issues.
I have no idea if it ran out, what I do know is it hadn't been 3 years.
It doesn't really matter anyways cause I was accused of 5 different speeding incidents at the time however they only put 3 points on my licence.

I also don't understand why my question has to do with earlier?
Base of the things, I was in court, they let me continue to drive in January and now I am going again, is it worth or not to get a lawyer?

So I had 9 points on my licence since before going to court. In January I was in court and they just removed my oldest offence that had 3 points and put this last one.

So basically you had 6 active points on your licence at the time of the offence?

No I had 9 points. I got punished in court and got to the appeals part where they said they were going to suspend my licence and if I had anything I wanted to say to prevent that.

I can't remember exactly what I said, something about needing the licence for work and that I was just distracted by it.

A Little bit about me.

I have 9 points on my licence. (I know I should be more attentive to my speed limit and pay attention to camera signs)
I am the same person that wrote this post: https://www.ftla.uk/speeding-and-other-criminal-offences/nip-s-arrived-over-a-month-of-offence-all-offences-on-the-same-road/msg105428/#msg105428 (I got £80 fine in the end and didn't get licence suspended)

I have once again gotten a speeding ticket, totally might fault.
Didn't see that the camera was not just for the red light. Did 43 in a 30.

Am going direct to court on this, no option given to go into speeding course as they say I this exceeds my allowed points.
Due to my history (Went to court in January and get given a second chance), is it even worth getting a lawyer for this?

I am kind of resigned that I will get my licence suspended and am preparing for the worse, however I still want to argue that I need my licence for work and this was just me being completely distracted and not used to having less cars on a road that usually busy. (I know this is not the best defence but think being honest is the only thing I got)

What is the weight that a lawyer might bring here and could they overturn this?

So I come back to this forum because I am still waiting for the outcome of this.

I identified myself in November for all the charges (still inside limit)

I also received a letter that I would be notified of court hearing.

Since then there has been no contact at all.

How long does it usually take for them to book dates?

What is the time limit on my charges?

Your use of American spelling is really starting to make my teeth itch.

sorry my phone auto-correct was set to that.

I have just fixed all my posts.

3. Since they wont suspend my license until I start identifying myself, would it hurt me asking for extended payment I if identified them at the end of the 20 day notice?

What is this "the 20 day notice" of which you speak?

You have apparently received 7 NIPs, all dated between 40 days and 58 days after the respective dates of offence, issued in 2 batches 8 days apart.

At first blush, if the RK receives a NIP ~6 weeks after the date of offence, the most likely explanation is that an earlier NIP was issued in time to be served within the 14 days, but apparently was never delivered, and the sausage machine generated a "reminder" when no response was received.
Or that the "RK" is not the RK - although apparently in this case, you are.

For 7 NIPs (or more) to be lost in the post, but 7 "reminders" to be delivered promptly is implausible.
For "reminders" to be issued in 2 batches, as opposed to a set period after each individual s. 172 response was due, there was IMHO likely to be a conscious intervention/override.

On the NIP I receive it says "28 days from this notice" and the date on the top is of 02/10.
Nowhere there is a August or September date.

Should it say reminder anywhere in the notice? Cause it doesn't. If it is what you say a conscious intervention, is there some grounds for a defence?

14
You say that you have not moved in over a year but the V5C is over two years old?

Sorry Im lost track of when I moved. Its over 2 years

15
Will definitely call them tomorrow
