We need to know where she was stationary. Once one starts to signal, and drive off, then one is "in traffic". If one is "in traffic" the contravention cannot occur, or else any line of traffic standing on the bus stop could be walloped with PCNs, which is obviously absurd.

Yes, she had parked on the single line before the bus stop.

Good evening,

My Auntie has just received this PCN below and she got it while she was trying to pull away and merge into the traffic.  She is a blue badge holder and had parked well before the bus stop.  The Video conveniently only shows her in the bus stop not the seconds before she entered the bust stop or after and one can clearly see she is trying to safely pull away but had to wait for an opportunity.  Looks very similar to one posted on here last year: https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/redbridge-pcn-high-road-seven-kings-(a)-stopped-on-a-restricted-bus-stop/#msg13484

The new V5 has arrived with updated Euro status.  I have sent Birmingham a message but do I also submit an appeal with the Adjudicator at the TPT or do I give Birmingham some time to come to their senses.

Thank you for your replies.  Yes, totally agree I will be appealing, I followed Birmingham's advice and phoned the DVLA CAZ customer service team (0300 029 8888) and spoke to a nice lady (Linda) who checked my car details and confirmed it is euro 6 but she said when it was registered the Euro 6 was not recorded in the right box of the V5 (Euro status section) please see screenshot below.  Apparently it sounds like a common problem.  Anyway she took all my details and had to refer it to another team so they can update the database.  She said that they may send me a new v5, however it can take up to 15 working days to process. 

In the meantime, BMW have swiftly sent me a Certificate of Conformity so I am waiting for the DVLA to their bit and I have all my ducks in a row before lodging an appeal.  I will let you know how I get on.  thanks

Civil penalty charge notices (Councils, TFL and so on) / Birmingham CAZ PCN

Good evening,

I hope you are well.

I was surprised to receive the PCN below from Birmingham council for my car even though it is a Euro 6 (ULEZ) compliant vehicle as I live in London.  As I thought there had been some sort of a mistake or database issue, I sent them a copy of my V5 and ULEZ statement proving compliance but today to my horror they have sent me a rejection below.  Please advise what do I do now?  Do I contact the DVLA and ask them to update their database - do I have any scope for appealing this?  This feels like a money grab. Any help much appreciated. Thanks

I submitted an appeal - please see text below but Redbridge have rejected it already and sent the following letter - please advise.  Thanks

Dear Sir/Madam, I am writing to formally appeal against the issuance of PCN AF30325618, issued for an alleged contravention 31J (entering and stopping in a box junction when prohibited). I believe that no contravention occurred, and I request that the penalty charge notice be reviewed and canceled for the following reasons. The vehicle entered the box junction only when the exit was sufficiently clear for the vehicle’s full length to proceed without obstruction. This is consistent with the legal requirements for entering a box junction, as per the Traffic Signs Regulations and General Directions 2016. Having reviewed the circumstances, I assert that: 1. The vehicle did not stop within the box junction due to the presence of stationary vehicles. 2. Sufficient space was available beyond the junction at the time the vehicle entered, enabling it to proceed fully. 3. The alleged contravention may have been incorrectly identified due to the angle of the camera or a misinterpretation of the footage. Numerous tribunal decisions have upheld that a contravention does not occur if the vehicle enters a box junction when there is clear and adequate space to exit. Based on this precedent and the specific facts of this case, I kindly request that the PCN be cancelled. Should this matter proceed further, I am prepared to present these details at an independent tribunal. Best regards
