I am so sorry to hear of your friend’s issue.

I’ve been going through a contentious probate issue for 3 years and it’s not cheap.

I hope for their sake that the solicitors now dealing with it are not Sheltons/Edward Hands & Lewis n. That is who has ‘dealt’ with my late mother’s estate.

You perhaps ought to try some local university law school to see if they could take this on Pro Bono.

It might be worth writing a letter of complaint to the solicitors and giving them 8 weeks to respond then get legal ombudsman involved.

However from my experience which is limited to my own there is usually only one winner and that is the solicitors. Their fees will plunder the trust unless the trust solicitors are altruistic. Unlikely…

My brother turned out to be a complete ****** if you read my woeful tale on here.

I wouldn’t **** on him if he was slowly burning to death with what he has put me through in the last 3 years.

I’ve bloodied his nose and his plan to defraud me didn’t work out too well for him but it’s cost me £28-£35k and I need to consider whether to force my mum’s solicitors first through the Senior Courts Cost Office and then the High Courts.

what has contentious probate got to do with anything?

I posted about my woeful life in the non traffic legal advice section. Sadly no-one replied and it’s still rumbling on

The ******* emailed me the other day to say the reason they have not distributed the estate is because my brother hasn’t replied with his bank details.

I wrote back to say I care not if his inheritance sits in their bank account for 20 years.

So not linked to this post but my solicitor keeps talking about costs after the event. But I never understood what ‘THE EVENT’ is classed as.

Feel free to read and comment on that other post. No-one has done so far.

3 years plus of sheer hell and my mother still hasn’t been interred.

Costs follow the event means that the loser of any particular claim or application normally pays the winner’s costs.

So it's as simple as that.

I'll revert to my post about this then - "This will raise a laugh... CONTENTIOUS PROBATE!"

there have been some spurious articles claiming this but are not genuine.
I was told by a muppet "teacher" at a SAC that there's "no such thing anymore" and went on to name a police force that doesn't exist.
So does it depend on the day, the Police Force and how the Officer is feeling?

I am guessing yes as that is the only explanation for my 2014 idiotic 108mph 'test' which ended up not being laid before the courts.

Ever failing memory sadly! I should have posted about it at the time.  Even if it was last week I wouldn't be able to recall it.
No, it’s not enshrined in law and never has been.

So I did a search again today and this is not the article I read (which I think may have even been in an online newspaper article at the time) and this came up!

So I take it that is nonsense too.  They mention speedometer regulations.  Maybe Construction and Use Regulations but this wouldn't amount to an 'allowance' of course.

You won't get a NIP unless your average speed was 57mph or higher as per the usual convention of only charging if your speed was (speed limit + 10% + 2mph).

Is this still the case? I read somewhere, cannot recall where, that these allowances had changed?

Sure there is something enshrined in legislation somewhere whether that be this or some revision.

Oh great! She's not off the hook yet then. I reckon you'll be correct. Thought it was too good to be true.

I've added some photos since of the signage.  I don't think there is ANY defence in all honesty.  I think a letter of appeal to them if one does come through citing that she "should have gone to Specsavers instead of Boots" would probably miss the target and not be appreciated and would open up another can of worms even though her eyesight for distance is fine.  Just a moment of forgetfulness she tells me and the daft thing is it's not as if she was in a rush!

Missus has just bloody called me after realising that she had driven down Canal Street in Nottingham going east to west.

I know it’s a bus lane and she said she didn’t not see any signs.

Funnily enough she was doing to Boots Opticians to collect her glasses!!!!  :D

Not sure if she made a formal appointment and she obviously paid for her test and glasses the other week when she went. I’d doubt it’s a defence as not being able to see is far worse.

I think it’s only reading glasses she requires. I’ll check.

Had a search for Canal Street and only find results for all the cash it has generated.

Is it worth fighting when it arrives?  She’s looked up costs already and apparently £35 if paid within 21 days. Hopefully that is within 21 days of receipt of NIP as we are away next Tuesday for 16 days.

Could have done without this but if it’s not worth fighting then it’s not worth fighting.

Will probably go and take photos of approach anyway just in case it helps others in future.

Well. Is this a turn up for the books?

Missus received nothing for this perceived contravention driving through the Canal Street Bus Lane in Nottingham. 

Is this even possible?  They've been raking millions of pounds in on this one bus lane.

Could the enforcement cameras have been broken?  It's just completely bizarre.

I am, of course, assuming that they need to issue within 14 days in these instances?

And yes it is a 24 hour bus lane according to the signage.

Maybe but surely unlikely as when you book an Uber it shows you where the taxi is and you generally book from the location you are standing so there should, theoretically, be no excessive waiting time.

For the first 30 days they can just reject for any faults.

30 days to 6 months the onus is on you to prove the faults did not exist at time of purchase, presumably you're not disputing it's a manufacturing defect.

The consumer is entitled to one of the following, at your discretion, in the first instance:

  • Repair
  • Replacement
  • Full or partial refund*

They are not entitled to refuse the first two options unless it will cause significant inconvenience, is disproportionate to the cost of the goods, attempts to repair or replace have failed, repair or replacement is impossible, or repair/replacement will take a significantly long time.

FWIW: I have claimed through S.75/Chargeback (the card company I use has the same form for both initially) and they did reach out to the other company for their side of the story. If you are complying with the consumer legislation I can't see them siding with the customer unless you're being unreasonable.

That said, would it cost you more in return postage than the CC fees?

Thank you.  In terms of return postage, we have a very good contract so it would be have far cheaper than the CC fees for him opening a case up which I think are either £15 or £25.  The fear was he would open a case anyway out of spite.  I didn't particularly like the way he spoke to me given that he had had over a month to open the item but it was clearly all our fault for not opening a sealed box and checking it over before it was sent out.  Perhaps that is a lesson for future. Open, inspect, take photos and re-seal but at the end of the day if the bike had left us in perfect condition and arrived with damage it would be of limited use to us in making a claim as ParcelForce would simply have rejected the claim as it was outside of the 30 days notice period for us to report.  A double-edged sword.  They've already failed to pay on claim of £430 for damage because my partner filled out the form with the wrong details.  I think she used her name instead of me being the signatory. That was an expensive lesson.

Anyway, it all turned out OK in the end. We offered him a 10% refund and a touch up paint stick.

Felt helpless when he'd had the bike for so long without bothering to open it and check it over. He wasn't particularly the best of communicators it has to be said.  Following his initial barrage and demands and following agreement, it was as if he hadn't read a word I'd said and started pestering for the refund and touch up stick before we got back from annual leave (despite the partial refund having been processed on 26th December and us not being able to send out the paint until we arrived back in the country as it needed a specialist paint shop to mix it up and match the bike colour exactly).

Turned up to do errand for my elderly mate and the guy from the shop told me that I would get ticketed where I pulled up on the same side as the BHF Shop.

Signs say otherwise so just hope my interpretation is right.  Presumably this would require an officer of the Council to actually slap a ticket on whilst I was loading.

Am I about to be caught?

An elderly friend of mine has asked me to help him pick up a fridge which he has purchased from the BHF Shop in Nottingham.  The lady there told him that you can load after 4:30pm opposite.

Knowing that you cannot chance anything these days, I've had a look on Google StreetView which is some 6 years out of date.

So I can see a tiny sign in a ridiculous place with the junction with Beastmarket Hill and Angel Row on double yellow lines.

Is this a legitimate place to stop?  If so, where exactly? And for how long?  Are double yellow lines restricted to 2 minutes loading?

Hoping to get a prompt reply as he needs me there at 4.30pm today.  In the meantime, I'll do some research just in case.

According to 'Road Markings' on Gov Website, double yellows mean "No waiting at any time" but there are faded single yellow marks on the kerb and if I am understanding this correctly and assuming those marks are still there some 6 years after the last Google StreetCar Visit then it is safe to load?

Question is I read somewhere that you have to switch the engine off.  Is this also correct please?

Also, Google Maps appears to want to route me down Market Street but that appears to be Tram only!


At the top of Market Street it says Tram and Cycles only on the road, there is a Tram and Cycles sign (but no ONLY plate below it) but on the left according to GSV, there was a sign saying "Except Buses and for loading at any time 4:30 - 10pm".  So would I technically need to be in a van to be classed as loading?

I've never been in a situation like this in all my years of knowing what I can and can't do since the introduction of trams.  Of course, rules change once you have passed your test 40 years ago.

I have had some fantastic advise from this and former forum, im so glad it was kept up, i have now subscribed for five years, i think with all the money you guys have saved me from handing over it is well worth the money and urge anyone else to do so, even just for the year to say thank you.

Can i suggest some kind of title instead of 'newbie' for forum supporters, or a badge that shows you have supported it for whatever amount of time paid ?
When @Southpaw82If you really want to help, get your knowledge up to the point where you can give advice and then help us respond to the endless stream of new posts, as soon as you start posting in high volumes the newbie badge will disappear.

Would it be an idea to set up a series of webinars that could help those interested to get up to speed?

I’d definitely be more than happy to help in any way I can.
