Got a PCN on windscreen around 13:40 for parking on the single yellow line outside the Ibis Hotel at 65 Lionel Street on Sunday, from Birmingham City Council - code 01 parked in a restricted street during prescribed hours:

Based on the map from the council website  https://www.birmingham.gov.uk/info/20109/parking/413/street_parking, Lionel street is in the Jewellery quarter zone. And from https://www.birmingham.gov.uk/info/20109/parking/413/street_parking/4, the hours of operation are Monday to Saturday - 8:00am to 6:00pm.

There is no clear sign on the street or at the road entrance. The driver checked the parking metre nearby which also shows the same hours and no charge on Sundays (see the photo). There are parking bays but were all full at the time. Based on the above info, I think it’s outside the hours of operation and should be free to park on the single yellow line on Sunday? What do you think?

How should I appeal? Thanks in advance.

After nearly 3 years, I (the registered keeper) received a Letter Before Claim from a solicitor "Moorside Legal" for a parking fine/invoice by Parking Control Management UK Ltd. See attached.

There is no detail about the case at all in the letter, and I don’t seem to find an email address from their website. I checked my notes and think it was at High Path Estate - SW19, the small car park on the south portion of Hayward Close (right next to the outdoor gym). I think the landowner is Housing Association.

We appealed before, mainly on the ground - breach of the IPC Code of Practice Schedule 1 .

"Signs should, where practicable, be placed at the entrance to a Car Park. Otherwise the signage within the Car Park must be such as to be obvious to the Motorist. "

There is no entrance sign. And the only sign that appears to relate to the car park is tiny and practically hidden, not placed in close proximity (but about 25 feet away from the parking spaces), i.e., the tiny one on the building behind the trees and green space, not obvious at all. The font size is too small to be able to signify it relates to the car park. So motorists cannot be expected to read a sign that they did not see because of its distance from the car park and because it is obscured by a tree which had a lot more leaves on it when the PCN was issued compared to the picture they showed as evidence (there is only one taken by them in winter 2019 when tree leaves already fell off).

Could you please kindly suggest our options?

Civil penalty charge notices (Councils, TFL and so on) / Merton Parking PCN
« on: September 19, 2023, 05:42:25 pm »
Hi,

I received a parking PCN by Merton council at Morden park Car park at 12:50 (free from 13:00!) on Saturday 9 Sep, Contravention code: 83. It's a pay and display. I did buy a ticket but for some reason it fell off of the dashboard (maybe because one window was left slightly open). It was unfortunate :(

I'd like to appeal and am following Merton's PCN site to challenge it. It shows this:
"We may be able to cancel your Penalty Charge Notice (PCN) if you are able to provide us with a copy of P&D ticket that would have been valid at the time of contravention.
In line with the appeals policy, an appeal may only be accepted if
• It can be shown that you displayed a valid P&D ticket at the time of the contravention
OR if all of the following are true:
• The ticket was on display, but was facing down or was otherwise unreadable, and
• the Civil Enforcement Officer (CEO) did not say that the obscured ticket was invalid, and
• the vehicle was otherwise parked in line with the Highway Code, and
• we have not cancelled a PCN for you in similar circumstances.
If you meet the criteria above then select ‘Continue’ to start the appeal. We will take you through the process of providing the evidence we need to allow us to cancel the PCN.
"

Is the ticket considered not on display? Oh another thing is that the ticket has the expiry time but doesn't have a purchase time. How should I write the appeal?

Thanks very much!
