Hi all me again. You may think I am an utter idiot for this  but hear me out. Really didn't mean to be a pavement hogger it is not nice.

I went to see my mum who has mobility issues and a blue badge issued by Hounslow Council (HC). There is not alot of space on the pavement agreed but enough for someone in a wheelchair or pushchair to safely pass. The pavement is wide and much bigger than it looks in rhe picture.

My brothers and sisters cars are there and cannot move anymore to give me space and they were not home anyway. What you cant see is a huge telephone post in front of our drive so this is the only way for me to park and reverse safely.

I needed to take my mum out and it takes her a while to safely get in and out of the car. I had my brother with me too and he has no independent road safety skills as he has autism. The road I reverse into is very busy so need time to get them both in safely and this is the only way. The main road is narrow and buses and cars pass on either side, and there are cars parked at the side of the road and they need to stop to pass. I once parked sideways on the pavement big mistake as it blocked traffic.

There is no pay and display and the other place to park across the road had no space as that is my only other option.

I saw someone as I came out but was too late as I didn't realise I was getting a ticket he had a hi vis jacket. He must have seen me and my mum coming out of the house but she walls slowly with a stick and physical support from me, she cannot go out alone independently.I took the picture about 5/6 minutes after my mum was in the car it was really hot so couldn't leave her and chase the guy

Do I have to take this on the chin or is it worth appealing?

Afternoon all,

I succesfully appealed a PCN when coming off the motorway into RRoad and it was cancelled. Stupidly I made the same  mistake but didn't realise until I was too late.I challenged this in Jan 26 as Enterprise sent the notice and had no response. I sent follow up emails a few months ago and nothing. A week ago I received the PCN which is now in my name. They have told me I need to appeal again as I wasn't the registered keeper so I couldn't appeal (rental) and now enterprise have transferred liability and I am now the keeper.

I have responded and told them I can appeal without being named the keeper and my previous challenge was successful. They already have the information so I will not resubmit as I sent this 6 months ago and the info is the same.

I don't think I am going crazy but this is a new one.

Sorry the website I was using to send attachments stopped working so figuring out another way.

Stupid me for beleving a wealthy family I went to work for. Awful road diversion so was an hour late, asked about off road parking they said it wss fine or they had a garage they could clear. Every road was residential so had to park, I assumed as they had a permit I could use it if I proved I was working. This is Kensington when I got home apparentlty they dont issue visitor permits. Why? How do you park there then.

Anyway to fight my way out?

Morning, can I please ask if I correct with the first stages of understanding a PCN are writing to the council for further information. I have two moving infractions within 3 minutes of each other but don't understand what they are for.

Thanks

Morning all,

A strange one. I rented a car for a few days in march and a few months ago revive a PCN stating the above. I did not rent the car for the dates the offence too place but enterprise hold me liable as I was apparently the last person to have the car and they won't accept any other explanation.

I managed to get the transaction reversed by my bank but enterprise are threatening beliefs. I also wrote to Richmond council who say the liability has not been passed onto me by enterprise. If I send them this letter is it enough for them to leave me alone or do I need to draft something else.

Thanks

Private parking tickets / Sainsburys whitechapel overstay Eurocarparks
« on: December 07, 2024, 03:53:03 pm »
Afternoon all,

This person has used great advice from Martin Lewis which had 2 PCNs cancelled. Is it worth challenging this, they haven't addressed all the points or mentioned the grave period which is 40 seconds over. There is advice to write to the CEO. If I challenge via POPLA and lose I'm assuming the discounted rate will be forfeited?

Thanks so much

This is what I sent below.

I have uploaded the response We confirm that  is the vehicle's hirer and keeper for the purpose of the corresponding definitions under Schedule 4 of the POFA Act 2012. I challenge this 'PCN' as hirer of the car and subsequently request all future correspondence be sent directly to myself at the address that you sent my PCN to. Now it is proven that in this instance, the registered keeper is not the "keeper" Eurocarparks Ltd  has no reason to contact Enterprise Ltd again regarding this PCN.The PCN failed to comply with the s requirements of Schedule 4 of POFA and consequently Euro Carparks Ltd has forfeited any right to claim unpaid parking charges from the vehicle's hirer and keeper. I deny any liability or contractual agreement, there will be no admissions as to who was driving and no assumptions can be drawn.

The PCN states the reason for issue as "overstay", the PCN is a vague template, I require an explanation of the allegation and your evidence to include a close up photograph of the sign contended at the location on the material date and images of the vehicle including the actual grace period agreed by the landowner. No information is provided regarding the policy with the landowner or on site businesses, to cancel such a charge. Please supply this as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Additionally, the following sections of POFA have also been breached.Keepers Liability and POFA 2012 paragraph 13(2) of POFA 2012 and Paragraph 14(2) and (3) of POFA 2012. We trust you will agree that it would be unreasonable for Euro Carparks Ltd to expect us to pay this charge.

Within 28 days please provide us with written confirmation of Euro Carpark Ltd's acceptance that it cannot and does not hold Enterprise Ltd liable for this parking charge and that this is now purely a matter between Eurocarparks Ltd and the driver.

You must either offer me a POPLA code or cancel the charge.

Thank you for your cooperation, I look forward to receiving your response within British Parking Association Ltd Code of Practice.

Yours faithfully,
