Any further advice from anyone else please?

Thanks stamfordman for the prompt reply.

I don't recall seeing advance signs of the width restriction and I can't see them on Google street map, though I appreciate that these are from last year.

The vehicle is registered to a company owned by a family member - therefore they have passed it on.

Thanks.

Copy of the PCN attached. I don’t think there is anything on the PCN that can be challenged - though would be keen to hear if I have missed anything.

My original questions still stand, and which form the basis of the appeal:

The lack of notice for vehicles wider than the specified wdidth (6ft 6inc) - its unlikely that wide vehicles would fit through and there is no safe escape route, and the absence of a sign stating that the white line area is for emergency vehicles only.

A BMW iX was involved with a width of 1980mm. This would not fit through the gap specified to go through, and so I think the argument can be made to cross the broken lines especially as there is inadequate notice warning the driver on approach, despite the ‘must do’ blue arrow.

The only other thing of note is that the vehicle is a company car and the PCN was sent to the DVLA registered address.

Hi all

Just writing for some advice.  I have received a PCN for Dennis Lane, Harrow for failing to copy with a sign.

This topic has come up before https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/dennis-lane-stanmore-harrow-code-38l-pcn-traffic-pass-to-left-sign-though-too-sm/msg93084/#msg93084)

In our situation a BMW iX was involved with a width of 1980mm. This would not fit through the gap specified and so I think the argument can be made to cross the broken lines especially if there is inadequate notice warning the driver on approach.

I know its unlikely to appeal due to the blue arrow which is a must do but can I appeal on these grounds: the lack of notice for wider vehicles, its unlikely the wide vehicles would fit through, and a sign stating that opening is for emergency vehicles only?

Link to PCN here:https://www.harrow.gov.uk/parking (YR22VKV)

Thanks to everyone for their thoughts!

Just completing the comms on this case.

I appealed this YBJ PCN and got a rejection from TFL. I did consider a further appeal but in the end reluctantly decided to pay the fine

7
Yes I will do this.

I was simply asking for an update on the case from the OP as it seems similar.

On the YBJ case I did contest and got a rejection from TFL. I considered appealing but in the end paid the discounted fine.

Hi

Was there an outcome to your appeal OP?

I have just had the same PCN come through. Happy to upload a copy of it and council footage but is there grounds to claim the opening is too small and not enough notice to divert away?

In our situation a BMW iX was involved with a width of 1980mm. This would not fit through the gap specified and so I think the argument can be made to use the gap especially if there is inadequate notice warning the driver on appproach. Any thoughts please?

In addition I think there should be a sign stating that opening is for emergency vehicles only?

Thoughts please? Very much appreciate everyone’s views.

Thank you. The other number cannot help with PCNs though I was told I can call 0343 222 3333 on Tuesday and they will be open which surprises me. Shame there is no other way to contact them

Thanks for all the rapid responses; very much appreciated.

They are unfortunately closed today - only open Monday to Friday and so I will need to wait until Wednesday now at the earliest. Is there an email address I can contact them on does anyone know please? At least if I can send an email I can delay the 14 days?

Worth a shot?

Like I said, I had a look at TFL PCN site using PCN ref and car registration details and it says 13 December representation rejected…you can look too

13
Hi

I understand that my representation may have been rejected. But I have not had an official communication about this (email, letter, etc). Am I meant to get a formal notification? I happened to have a look at the TFL PCN site and it looks as though the representation has been rejected.

Thank you. That is very much appreciated.

Thanks for the draft response. Has anyone got anything else to add please?
