Make an appeal as KEEPER to PE stating that the driver entered, made attempts to pay via the app but was unable to precisely identify the car park on the app.

The driver then left and, as such, no contract was ever formed and hence no contract could be breached.




There are other PoFA issues with the PCN but we can raise these if it comes to POPLA.

Thank you, I'll them to appeal on these grounds and see how it goes.

Hello,
The driver of a vehicle entered a private car park managed by ParkingEye. The payment machine wasn't working so they attempted to use the ParkingEye app to pay, unfortunately it repeatedly failed to work (couldn't find correct car park they were in).

Not being able to pay the driver left the car park 7 minutes after entering and found somewhere else to park. The driver also decided not to stay and make further attempts at paying as the condition of the car park was quite poor (potholes, unsecure).

They've now recieved a private parking charge for the 7 minute stay. Is this something that can be appealed with any chance of success?

Was the driver not entitled to a reasonable amount of time to read parking sign T&Cs and attempt payment before deciding to leave? 5 minutes grace period didn't seem enough.
